风险社会视角下食品安全犯罪立法完善研究

【摘要】：随着社会不断发展，生产力的不断进步，社会形态已经从传统社会转变为风险社会。基于特定的社会状态和历史时期，风险已经从简单的海事概念转变为更为复杂的概念，具有决策决定性、认识模糊性、后果难以预测性等特性。与此同时，也出现了许多风险社会带来的社会问题，食品安全问题以及食品安全犯罪即是其中非常明显的问题。对于风险社会中的社会问题的研究毋庸置疑的是解决当今社会问题的一条必经之路，而食品安全在人们生活中又占有非常重要的地位，因此，食品安全在风险社会中的法律规制又是重中之重。立法的完善本身就是为了更好的顺应社会发展，解决各个时期的社会问题，预防犯罪，打击犯罪。从1979年刑法至今，我国刑法经历了各个阶段的发展，逐步趋于成熟，但是社会发展是不断进行的，刑法完善也应跟随其步伐。针对当今风险社会的各种特征，，以及风险社会中食品安全的特征，研究我国刑事立法方法，无疑能够带来顺应社会发展的一种立法转变。本文将从风险、风险社会以及风险社会视角下的食品安全等角度阐述风险社会与当今刑法之间的紧密关系。并从我国食品安全犯罪相关立法沿革以及国外的立法优点等方面进行研究和探索，最后对于食品安全犯罪归属问题，增设食品安全犯罪的新型犯罪，应扩大食品安全犯罪的行为类型等方面阐述对于我国食品安全犯罪立法完善方面的建议，以寻求新时期我国刑法对于食品安全犯罪方面的立法完善之道。
[Abstract]:With the continuous development of society and the development of productivity, the social form has changed from traditional society to risk society. Based on the specific social state and historical period, risk has changed from a simple maritime concept to a more complex one. It has the characteristics of decisionmaking, fuzzy cognition and unpredictable consequences. At the same time, there are many social problems brought about by risk societies. The problem of food safety and food safety crime is one of the most obvious problems. The study of social problems in a risky society is undoubtedly the only way to solve the social problems of today's society. Food safety plays a very important role in people's life, therefore, the legal regulation of food safety in the risk society is the most important. The perfection of legislation itself is in order to better conform to the social development, solve the social problems of each period, prevent crime, crack down on crime. From 1979 to now, the criminal law of our country has experienced the development of various stages, and gradually tends to mature. However, the development of society is going on continuously, and the perfection of criminal law should follow its steps. According to the characteristics of risk society and food safety in risk society, this paper studies the methods of criminal legislation in our country. Undoubtedly, it can bring about a kind of legislative transformation that conforms to the development of society. This article looks at the risks, From the perspective of risk society and food safety in the perspective of risk society, this paper expounds the close relationship between the risk society and the present criminal law, and studies and explores the legislative evolution of food safety crime in China as well as the advantages of foreign legislation. Finally, regarding the problem of the attribution of food safety crime and the establishment of a new type of food safety crime, it is necessary to expand the behavior types of food safety crime and to elaborate the suggestions on perfecting the legislation of food safety crime in our country. In order to seek the new period of China's criminal law for food safety crime legislation to improve the way.
