非典型虐待行为的刑法规制

【摘要】：近年来,关于非家庭成员之间发生的虐待行为越演越烈,引起了社会广泛的关注,比如保姆虐婴案、“铁血”护工案、教师虐待学生案等,这些案件在引起大家关注的同时,也引发刑法理论界关于虐待犯罪的探讨,各种论文见诸专业期刊,学者们都认为现行刑法规定的虐待罪已不能解决此类案件。因此不管是社会人士还是刑法学家们纷纷呼吁修改虐待犯罪之规定。在这样的呼声中,2015年11月1日迎来《中华人民共和国刑法修正案九》(下称《刑法修正案九》)的正式施行,其中在刑法第二百六十条虐待犯罪后增加一条作为二百六十条之一,同时最高人民法院、最高人民检察院《关于执行中华人民共和国刑法确定罪名的补充规定(六)》将第二百六十条之一(《刑法修正案九》第十九条)的罪名确定为虐待被监护、看护人罪,虽有进步之处,但《刑法修正案九》第十九条关于虐待犯罪的修改仍存在一些不足,比如虐待被监护、看护人罪并不能包含所有的非典型虐待行为。本文主要从案例入手,提取案例存在的共同问题,对非典型虐待行为进行概述,然后通过对非典型虐待行为的罪与非罪、此罪与彼罪进行分析,并结合《刑法修正案九》关于虐待犯罪的修改之处以及所增加罪名即虐待被监护、看护人罪做出评价。除导论和结语外,本文分为四个部分,主要内容如下：第一部分是对非典型虐待行为的概述。通过对虐待行为以及典型虐待行为的解释,然后界定什么是非典型虐待行为,即非典型虐待行为是指存在监督、管理、雇佣、监护、看护等特定权利义务关系的非家庭成员之间经常、持续性的使用暴力或者其他残忍手段。使被害人身体和精神受双重折磨,情节恶劣的行为。通过对非典型虐待行为概念的界定了解非典型虐待行为的构成特征,从而正确区分怎样的非典型虐待行为才是犯罪。第二部分是对非典型虐待行为的认定。在分析非典型虐待行为罪与非罪的基础上,对虐待行为与刑法中相类似犯罪行为进行比较分析,主要是与故意伤害行为、侮辱行为、寻衅滋事行为的区分,并在此基础上总结自己的结论。第三部分是对现行刑法关于虐待行为规制的评价。现行刑法对虐待犯罪作了不少修改,比如扩大了虐待主体的范围,强调对特殊弱势群体的保护,区分了典型虐待行为与非典型虐待行为的量刑幅度等,但是《刑法修正案九》对虐待犯罪的修改还存在着一些缺陷,比如扩大的主体不能涵盖所有虐待情形；权力保护存在偏颇；不能有效衔接其他罪名,因此,针对存在的问题,笔者提出一些具体完善的建议,重新设计法条。对于这篇论文,笔者还存在一些不足之处,有些观点可能较为肤浅,希望大家指正。
[Abstract]:In recent years, the increasing intensity of abuse among non-family members has aroused widespread concern in society, such as babysitter cases, "iron blood" nursing cases, cases of teachers abusing students, and so on. These cases have aroused people's attention at the same time. It also led to a discussion on the crime of abuse in the theoretical circle of criminal law, and various papers were published in specialized journals. Scholars believe that the crime of abuse under the current criminal law can no longer solve such cases. Therefore, both the community and criminologists have been calling for amendments to the provisions of the crime of abuse. In such calls, on November 1st 2015, welcome. For the official implementation of the Ninth Amendment to the Criminal Law of the people's Republic of China (hereinafter referred to as the Ninth Amendment of the Criminal Law), Of these, one article was added as one of 260 articles after the crime of maltreatment under Article 260th of the Criminal Law. At the same time, the Supreme people's Court, The Supplementary provisions of the Supreme people's Procuratorate on the execution of the crimes established by the Criminal Law of the people's Republic of China (6) > defines one of the 260th articles (Article 19th of the Amendment to the Criminal Law) as the crime of mistreating the person under guardianship and taking care of the person, Although there has been some progress, there are still some shortcomings in the amendment of Article 19th of the Amendment to the Criminal Law on the crime of abuse, for example, the crime of abuse being monitored, the crime of caregiving can not include all atypical acts of abuse. The common problems in the case are extracted, the atypical abuse is summarized, and then the crime and the crime are analyzed through the crime and non-crime of the atypical abuse. In addition to the introduction and the conclusion, this article is divided into four parts, combining with the revision of the crime of mistreatment in the Ninth Amendment of the Criminal Law, as well as the appraising of the additional charges, that is, the crime of being under guardianship and the crime of taking care of the person. The main contents are as follows: the first part is an overview of atypical abuse. Through the explanation of abuse and typical abuse, then define what is atypical abuse, that is, atypical abuse refers to the existence of supervision, management, The frequent and persistent use of violence or other cruel means between non-family members of certain rights and duties, such as employment, guardianship, care, etc., which causes the victim to suffer both physically and mentally, The definition of the concept of atypical abuse. The second part is the identification of atypical maltreatment. On the basis of analyzing the crime of atypical abuse and non-crime, A comparative analysis is made between maltreatment and similar criminal acts in criminal law, which are mainly distinguished from intentional injury, insulting behavior, provocative and troublesome behavior, The third part is the evaluation of the current criminal law on the regulation of maltreatment. The current criminal law has made many amendments to the crime of abuse, such as expanding the scope of the subject of abuse. Emphasizing the protection of special vulnerable groups and distinguishing the sentencing range between typical and atypical abuse, but the amendment of the Ninth Amendment to the Criminal Law still has some defects in the revision of the crime of abuse, For example, the enlarged subject cannot cover all cases of abuse; the protection of power is biased; and other crimes cannot be effectively linked. Therefore, in view of the existing problems, the author puts forward some concrete and perfect suggestions and redesigns the law. For this paper, I also have some shortcomings, some views may be more superficial, I hope you correct.
