我国罪名建言热潮之隐忧及其批判

【摘要】：我国总是存在设立各种新罪的立法建言,因为建言者认为现行刑法存在漏洞。但他们所理解的漏洞,有的是因为作出片面解释而造成不应有的漏洞,有的是因为没有进行法益解释造成不应有的漏洞,有的是因为进行了消极解释而造成不应有的漏洞,有的是因为过于追求立法的精细而造成不应有的漏洞,有的是因为忽略立法类型化原则而造成不应有的漏洞,有的是因为漠视刑法的最后手段性而造成不应有的漏洞。这些罪名建言存在形形色色的不足:加大刑法条款日趋膨胀的风险,扩张了刑法处罚范围,抑止了刑法解释功能的发挥,容易导致立法虚置,增大了刑法学习和适用难度。罪名建言要慎重考虑公众认同,罪名建言要遵循刑法专业特色,人大代表要慎用罪名建言的提案权,刑法的完善既要适度修正,更要合理解释。
[Abstract]:In our country, there are always legislative proposals for the establishment of various new crimes, because the proponents believe that there are loopholes in the existing criminal law. However, some of the loopholes they understand are caused by partial interpretation. Some are due to the lack of legal interpretation, some are caused by negative interpretation, and others are caused by the pursuit of legislative fineness. Some of these loopholes are caused by the neglect of the principle of the categorization of legislation. Some of them are caused by the disregard of the last resort of the criminal law. There are many kinds of shortcomings in the proposition of these charges: increasing the risk of the increasing expansion of the provisions of the criminal law, expanding the scope of criminal punishment, It has restrained the function of criminal law interpretation, easily led to legislation void, increased the difficulty of studying and applying criminal law. The proposal of charges should be carefully considered by the public, and the proposal of charges should follow the professional characteristics of criminal law. Deputies to the National people's Congress should be careful to use the right to propose charges, and the perfection of the criminal law should not only be amended moderately, but also reasonably explained.
