内在客观处罚条件的性质定位与主观认定新进路

【摘要】：内在客观处罚条件是犯罪构成要件要素中的独特类型,其通过增加行为恶性使行为达到刑法规制范围。在主客观一致的责任主义原则要求下,根据先行行为的性质,可以将这一特殊构成要件的主观方面评价为间接故意。同时通过其他责任要素的削减实现犯罪与刑罚的平衡。
[Abstract]:The internal objective punishment condition is the unique type in the elements of the elements of the constitution of a crime, which makes the behavior reach the scope of the criminal law regulation by increasing the malignancy of the behavior.According to the nature of the antecedent act, the subjective aspect of this special constitutive element can be evaluated as indirect intention.At the same time, through the reduction of other elements of responsibility to achieve the balance between crime and punishment.
