试论我国知识产权刑法保护的缺陷及重构

【摘要】：随着我国经济与社会的不断发展,知识产权这一较为陌生的词汇逐渐走入我们生活,成为了我国经济发展的重要推动力。为了保证知识产权方的合法利益,并以此推动经济的全面发展,我国近年来对知识产权领域犯罪的处罚力度正逐年加强。不过在我国对知识产权领域犯罪处罚力度加强的背后,也反映出了我国知识产权相关领域犯罪活动的猖獗,笔者就我国知识产权保护的缺陷及重构进行论述,希望能对我国知识产权领域的相关发展带来一定启发作用。
[Abstract]:With the development of our economy and society, intellectual property, a relatively unfamiliar word, has gradually come into our life and become an important driving force for the economic development of our country. In order to guarantee the legitimate interests of the intellectual property parties and promote the overall development of the economy, the punishment of crime in the field of intellectual property in China has been strengthened year by year. However, behind the intensification of criminal penalties in the field of intellectual property rights in China, it also reflects the rampant criminal activities in the field of intellectual property rights. The author discusses the defects and reconstruction of the protection of intellectual property rights in China. Hope to bring some enlightening effect to the related development of intellectual property in our country.
