【摘要】:雇佣犯罪是指一方通过提供财产性利益或其他特定利益,要求另一方单独实施或与其共同实施犯罪的一种犯罪类型。刑事立法并未对雇佣犯罪这一犯罪类型进行明确规范,且实践中对雇佣犯罪的定罪、量刑大多局限于典型的雇佣犯罪,故在很大程度上影响了司法的准确性和量刑的适当性。刑法理论界往往专注于纯正型雇佣犯罪与不纯正型雇佣犯罪的研究,却未将不具备刑事责任能力的主体雇佣犯罪囊括在内,致使雇佣犯罪的研究并不完整。雇佣犯罪中的雇主的刑事责任能力应当不受到限制,但雇主与受雇人皆不具备刑事责任能力的情形排除在外。在雇佣双方皆具备刑事责任能力的雇佣犯罪中,雇主为教唆犯或共同正犯,该犯罪成立共同犯罪;若仅雇主具备刑事责任能力,雇主可能成立间接正犯或者单独正犯,故此时该犯罪不构成共同犯罪;若仅受雇人具备刑事责任能力,受雇人构成独立犯罪。雇佣双方的刑事责任大小因其所参与的雇佣犯罪的性质差异而不同。立法应该考虑将“(受)雇佣”作为一种量刑情节予以法定化,这既有利于打击此类犯罪,也更有利于刑事司法公正的实现。
[Abstract]:Employment crime is a kind of crime that one party requires the other party to commit the crime alone or jointly with the other party by providing property interests or other specific interests. Criminal legislation does not clearly regulate the type of employment crime, and the conviction of employment crime in practice, sentencing is mostly limited to the typical employment crime, so to a large extent affected the accuracy of the judiciary and the appropriateness of sentencing. The theory of criminal law often focuses on the research of pure employment crime and non-pure employment crime, but does not include the subject employment crime which does not have the ability of criminal responsibility, so the study of employment crime is not complete. The criminal liability capacity of the employer in employment crime should not be restricted, but the situation that neither employer nor employee has criminal liability capacity is excluded. In an employment crime in which both the employer and the employer have the ability to be criminally liable, the employer is an abettor or a co-principal offender, and the offence is a joint crime; if only the employer has the ability to be criminally liable, the employer may establish an indirect principal offender or an individual principal offender, Therefore, the offence does not constitute a joint offence; if only a servant has the capacity to be criminally liable, the servant constitutes an independent offence. The criminal liability of both parties varies according to the nature of the employment crime in which they are involved. Legislation should consider legalizing "employed" as a kind of sentencing circumstance, which is not only conducive to cracking down on such crimes, but also conducive to the realization of criminal justice.
