论国家监察体制重构的基本问题与具体路径

【摘要】：国家监察体制得以重构主要基于两重因素:原有体制在实践中彰显出的多重管理、叠床架屋、同体监督、程序衔接等问题,严重制约了机制运行的实效;中央层面强化、理顺和优化国家监察体制及其权能的战略定力和决心。《试点方案》和《试点决定》的相继出台,标志着国家监察体制的重构拉开了序幕。以此为契机,国家监察体制的重构当积极稳妥地推进,并且注意合理借鉴历史与域外的有益经验,避免出现"冒进"或"大跃进"现象,最终致力于建立集中统一、权威高效的监察体系。
[Abstract]:The reconstruction of the state supervision system is mainly based on two factors: the problems of multiple management, superimposed structure, in-body supervision and procedure connection, which have been highlighted by the original system in practice, have seriously restricted the effectiveness of the operation of the mechanism, and have been strengthened at the central level. The strategic determination and determination to rationalize and optimize the state supervision system and its power. The introduction of "pilot program" and "pilot decision" one after another marks the beginning of the reconstruction of the state supervision system. Taking this as an opportunity, the reconstruction of the state supervision system should be actively and steadily advanced, and attention should be paid to the rational use of historical and foreign beneficial experience to avoid the phenomenon of "bold advance" or "Great Leap forward", so as to ultimately devote themselves to the establishment of centralization and unification. An authoritative and efficient supervisory system.
