关于拒不支付劳动报酬犯罪问题的探讨——以犯罪经济学为视角

【摘要】：当前,我国拒不支付劳动报酬犯罪高发,是最使农民工头痛,也是严重危及治安稳定的重大社会问题,如何妥善处置成为当务之急。为遏制该类行为,《刑法修正案(八)》将其犯罪化,但问题并未因此得到解决。犯罪背后,隐藏着犯罪分子成本——收益的理性考量,同时也是与追诉机关的博弈。从犯罪经济学的角度,运用经济模型对此问题探讨,进而在犯罪经济学视野下提出防控对策,以期对遏制该罪有所启示。
[Abstract]:At present, the high incidence of crime of refusing to pay for labor in China is the most headache for migrant workers and a major social problem seriously endangering public security and stability. How to deal with it properly has become a top priority. From the angle of criminal economics, this paper discusses this problem by using economic model, and then puts forward prevention and control countermeasures from the perspective of criminal economics, with a view to curbing the crime.
