结果加重型绝对确定死刑的困境与出路——以劫持航空器罪为例

【摘要】：对于在一档量刑幅度内,主刑仅为死刑的情况,理论上称为绝对确定死刑。按照适用绝对确定死刑前提条件的不同,可以分为情节加重型绝对确定死刑和结果加重型绝对确定死刑。相较于情节加重型绝对确定死刑而言,结果加重型绝对确定死刑弊端更加明显,无论是在立法还是司法层面都会遇到一系列的问题与困惑,因此对结果加重型绝对确定死刑进行立法完善更为紧迫。将结果加重型绝对确定死刑的"……处死刑"立法模式修改为"……可以判处死刑"这种相对确定死刑的立法模式,可为困境中的结果加重型绝对确定死刑提供一条刑事立法意义上的出路。
[Abstract]:In a range of sentencing, the main penalty is only the death penalty, theoretically called absolute certainty of the death penalty. According to the difference of the prerequisite conditions of applying absolute determination of death penalty, it can be divided into two types: the type of aggravating circumstances, the type of absolute determination of death penalty and the type of aggravating result. Compared with the absolute determination of the death penalty with aggravating circumstances, the disadvantages of the absolute determination of the death penalty with aggravated results are more obvious, and there are a series of problems and puzzles both in legislation and in the judicial level. Therefore, it is more urgent to perfect the legislation of the death penalty. Absolute determination of the death penalty by aggravating results ". The legislative model of the death penalty has been revised to. The legislative model of "the death penalty can be sentenced to death" can provide a way out in the sense of criminal legislation for the absolute determination of the death penalty in the difficult situation.
