死刑量刑程序的现状反思与模式重塑——基于实证的分析

【摘要】：我国未对死刑案件与普通刑事案件作有效切割,死刑裁判长期存在着"重定罪而轻量刑"的不良倾向,整个庭审活动主要围绕定罪进行,量刑无法成为庭审的实质内容。死刑量刑附属于定罪程序,存在着干扰法官量刑心证、合议庭量刑虚置、陪审量刑适用率低、控辩双方参与量刑受限等一系列量刑非实质化问题。定罪量刑程序彻底分离才能保证死刑量刑的适当与公正,符合死刑量刑程序的国际趋势。死刑案件量刑程序的改革应以实现死刑量刑实质化、控制死刑适用、保证死刑量刑公正为目标,严格遵循"先定罪、后量刑"的两阶段庭审结构,重塑具有本土特色的完全独立的死刑量刑程序模式。
[Abstract]:Death penalty cases and ordinary criminal cases have not been cut effectively in our country. Death penalty judgment has a bad tendency of "heavy conviction but light sentencing" for a long time. The whole trial activity mainly revolves around conviction, sentencing cannot become the essential content of the trial. The death penalty is subordinate to the conviction procedure, there are a series of non-substantial problems of sentencing, such as disturbing the judge's sentencing heart evidence, the collegial panel's sentencing is false, the application rate of the jury sentencing is low, the prosecution and the defense participate in the sentencing limitation, and so on. Only the complete separation of conviction and sentencing procedure can ensure the proper and fair sentencing of death penalty, which accords with the international trend of sentencing procedure of death penalty. The reform of sentencing procedure in death penalty cases should aim at realizing the essence of death penalty sentencing, controlling the application of death penalty, ensuring the fairness of sentencing of death penalty, and strictly following the two-stage trial structure of "first conviction, then sentencing". Remoulding a completely independent sentencing procedure model with local characteristics.
