论不纯正不作为与作为犯罪的界分

【摘要】：不纯正不作为在一定程度上突破了犯罪的范围,拓展了犯罪圈,使得对相关危害行为的定性更为合理。在区分作为和不纯正不作为的时候,必须将行为的个数予以明确,不能将几个行为作为一个行为来判断和评价;必须明确行为不同的社会意义,并以此来区分作为和不纯正不作为;要区分作为和不纯正不作为行为必须找到需要法律评价的部分,而不能将法律并不予评价的内容也纳入区分的范围;区分作为和不纯正不作为要围绕法益的保护进行。
