共犯责任退出机制的反思性检讨:修正因果关系遮断说的构建

【摘要】：在违法连带思维惯性作用之下共犯责任认定机制呈现"宽进严出"的失衡景象。应回归因果共犯论的立场原义之上,将个人责任主义原则与违法相对思维内嵌于共犯责任退出机制之中。修正因果关系遮断说将遮断标准予以规范软化。物理因果关系的遮断考察以客观风险之消解作为评价目标,实现事实因果关系的规范渗透。心理因果关系的遮断考察以法规范的震动平复作为评价目标,并行构建包括脱离意思之现实传达以及真挚努力之实际付出的双层检验机制。通过对因果关系遮断标准的规范修正,衡平共犯责任的进入和退出机制,能够实现共犯责任维度的合理廓清。
[Abstract]:Under the inertia of illegal joint thinking, the cognizance mechanism of accomplice responsibility presents the imbalance of "wide entrance and strict output". We should return to the original meaning of causal accomplice theory and embed the principle of personal responsibility and the relative thinking of violation into the withdrawal mechanism of accomplice responsibility. The correction causality theory will regulate and soften the blocking standard. In order to realize the normative penetration of factual causality, the objective is to eliminate the objective risk. The objective of the evaluation is to construct a double-level inspection mechanism which includes the reality transmission of disconnection from the meaning and the actual effort of sincere effort as the objective of evaluation of the psychological causal relationship in which the vibration of the legal norm is taken as the evaluation goal. The reasonable clarification of the dimension of accomplice liability can be realized by amending the criterion of causality blocking and equalizing the entry and exit mechanism of accomplice liability.
