河长制四题——以行政法教义学为视角

【摘要】：行政法建构河长制的目标是实现整体性治理,克服河湖行政执法碎片化现象,将河湖行政执法中的以政府职能部门为本位的利益观转变为作为整体的政府为本位的利益观;行政法建构河长制的基础是明确河长的职权(责),即需要将河长治理河湖的职权(责)来源形式再合法化,以及职权(责)之再类型化;行政法建构河长制的关键是确立整体性协调机制,即建立河湖行政执法的整体性预算制度与整体性结构协调制度;行政法建构河长制的重心是建立和健全针对河长的监督机制,包括建构司法机关和专门机关对河长的监督机制,健全公民、法人和其他组织,以及行政机关内部对河长的监督机制。
[Abstract]:The goal of administrative law construction is to achieve holistic governance and overcome the fragmentation of administrative law enforcement in rivers and lakes. Transform the view of profit based on the government function department in the administrative law enforcement of river and lake into the view of interest based on the government as a whole; The foundation of constructing river length system in administrative law is to make clear the authority (responsibility) of river length, that is to say, it is necessary to legalize the source form of authority (responsibility) of river and lake management, and to retype authority (responsibility); The key of constructing river length system in administrative law is to establish the overall coordination mechanism, that is, to establish the overall budget system and the overall structure coordination system of river and lake administrative law enforcement. The focus of administrative law construction is to establish and improve the supervision mechanism for river length, including the construction of judicial organs and specialized agencies to monitor the river length, the sound citizens, legal persons and other organizations.
