辅警行为的法律规制

【摘要】:社会对安全的迫切需要和警力不足的现状使得辅警的行为尤为重要。中国是一个人口大国,面对纷繁复杂的社会治安问题,我国的警力已有些力不从心,因此社会上出现了辅警这个新的群体。但是面对这样一个庞大的群体,却没有一部法律、法规对其行为进行规制,这是的很危险的,因为辅警拥有警察的一部分权力,但是没有法律对其权力和行为进行规制,这样就会导致权力的滥用。正是因为没有法律的规制,辅警人员的权益也难以得到保障,从而导致辅警违法犯罪行为的增加。因此对辅警行为的规范应该从立法着手,完善辅警的准入机制、健全辅警的考核和培训机制,提升辅警的福利待遇,这样才能更好地规范辅警的行为,更好地保护辅警的合法权益,更好地为人民群众做贡献。 本文第一部分从辅警行为的概念和特征入手,着重对辅警行为的性质究竟是行政授权行为、行政委托行为还是行政辅助人的行为进行了深入的分析,并提出了自己的观点和看法。 本文第二部分从辅警行为存在的必要性入手,分析了辅警行为在我们社会管理中的重要性,但同时,正是因为没有对辅警行为进行法律规制,导致了辅警失范行为的产生,辅警失范行为表现为不当行为、违法行为和犯罪行为三种,作者通过真实的事例来说明辅警的失范行为对国家、社会和人民产生的巨大危害。同时,作者还深入剖析了辅警失范行为产生的原因,包括立法的缺失、招录、考核、培训制度的不健全、对辅警权益保障不充分等原因。 本文最后一部分是对辅警行为法律规制的建议,作者首先提出了辅警行为时所应遵循的基本原则,根据依法行政原则、合理行政原则、程序正当原则、高效便民原则、诚实信用原则和权责统一原则这些基本原则来进行制度的构建。首先要对辅警行为进行立法规制,只有从立法上确立辅警制度,才能够让辅警的行为有法可依,避免工作的随意性和多样性,这样我国辅警才能走上正规化、法治化的发展道路。其次,要完善辅警的招录制度,辅警的招录是辅警队伍素质高低非常重要的一个环节,只有把好辅警的准入关口,才能提升辅警队伍的素质和战斗力。同时,不仅要健全和完善辅警的管理体系,还要完善辅警的考核和培训制度,回避和辞退机制,有了这些制度的保障才能激发辅警的工作热情。最后是要提高辅警的福利待遇,充分保障辅警的合法权益。只有这样,才能让辅警更好的服务社会,我们的社会才能更加的和谐、有序。
[Abstract]:The status quo of social security problems and the urgent needs of the police auxiliary police behavior is particularly important. But in the face of such a huge group, but no legal regulations, to regulate their behavior, this is very dangerous, because the police have auxiliary part of the power, but not the law of its power and conduct regulation, which will lead to the abuse of power. It is because there is no legal regulation, auxiliary personnel rights cannot be guaranteed thus, resulting in the increase of auxiliary police crimes. So the auxiliary behavior should from the legislation to improve the access mechanism of the auxiliary police, auxiliary police training and improve the assessment mechanism, improve the welfare of the auxiliary police In this way, we can better standardize the actions of the auxiliary police, better protect the legitimate rights and interests of the auxiliary police, and make better contributions to the people.
The first part of the article starts with the concept and characteristics of the auxiliary police behavior, and focuses on the nature of the behavior of the auxiliary police, whether it is administrative authorization, administrative entrustment or the behavior of the administrative assistant.
The necessity of the second part of this article from the auxiliary police behavior, analyzed the importance of auxiliary police behavior in our social management. But at the same time, it is because there is no legal regulation of auxiliary police behavior, led to the auxiliary police anomie, auxiliary police misconduct is not as behavior, illegal behavior and three kinds of crime, the author through the real example of the auxiliary police misconduct to the state, society and people have great harm. At the same time, the author also analyzes the reason of auxiliary anomie behavior, including the lack of legislation, recruitment, assessment, training system is not perfect, the auxiliary police the protection of the rights and interests is not sufficient reason.
The last part of this paper is on the auxiliary legal regulation proposals, the author puts forward the basic principles of auxiliary police behavior, according to the principles of administrative law, the administrative reasonable principle, the principle of due process, convenient and efficient principle, the principle of honesty and credit and the responsibilities of the original unity of these basic principles for the construction of the system. First of all to the legislation of the auxiliary police behavior, only from the legislation on the establishment of auxiliary system, can make the auxiliary police behavior of the law, to avoid the randomness and diversity, so that our auxiliary police to go on standardization, development of the rule of law. Secondly, to improve the system of recruiting auxiliary police, auxiliary police recruiting is a very important part of the auxiliary police team quality, only good auxiliary access points, in order to enhance the quality of the auxiliary police team and fighting force. At the same time, not only to improve and perfect the management system of the auxiliary police The Department, but also improve the assessment and auxiliary training system, avoidance and dismissal mechanism, with the system in order to stimulate the enthusiasm of the auxiliary police.
