教师体罚法律问题研究

【摘要】:在我国,虽然教师体罚学生的行为在多部法律中属于被禁止的违法行为,但在现实生活中教师体罚事件却屡禁不止。教师体罚事件的不断发生与社会因素、文化因素、经济因素、法制因素、教师心理健康因素、教师个人素质因素等多重因素息息相关,并且我国的教育立法对有关教师体罚的规定多为原则性规定,并没有对教师体罚内涵和外延的明确界定,致使与教师体罚相关的法律条文可操作性差,这也是造成教师体罚产生的主要因素。除此之外,学术界对教师体罚的研究大多是从心理学、社会学、经济学等角度进行的分析研究,较少有学者从法律角度研究。教师体罚不利于维护社会稳定、阻碍依法治校的进程、破坏教师的形象,值得重视的是教师体罚最大的危害是伤害受罚学生的身心健康。近年来,我国教师体罚事件频频发生,甚至有增长的趋势,这一问题应引起立法者的高度关注。当前,社会各界越来越多人呼吁禁止教师体罚,但是对如何确认教师体罚、如何区分体罚、惩罚和惩戒等问题还不明确。由此造成两种负面现象,一方面个别教师会利用法律漏洞继续实施体罚;另一方面会造成部分教师对学生错误行为放任自流。针对上述问题,本文结合国内外研究现状和主要成果,采用规范分析法、案例分析法、比较分析法和问卷调查法对教师体罚的法律问题进行研究。本文研究的主要内容共分为五个部分:第一部分:绪论部分,对文章选题背景、意义和国内外研究现状的梳理,并且对文章的研究思路、研究方法和创新点予以阐述。本文从法律角度研究教师体罚现状,力图为维护学生合法权益提供更为有效的保障。第二部分:主要是对教师体罚概念进行界定、论述教师体罚的特征,并对教师体罚的属性进行法律分析。教师体罚行为与我国宪法、刑法、民法等多部法律法规的法律精神相违背。第三部分:通过对教师、家长、学生进行问卷调查,分析教师体罚现状调查。第四部分:通过阐述教师体罚的主客观构成要件及其归责原则,明确教师体罚应当承担的法律责任。第五部分:对防治教师体罚的法治路径及策略进行研究,通过完善教育实体法律制度、教育程序法律制度、教育监督法律机制、教育救济法律制度等阐述防治教师体罚的具体路径。
[Abstract]:In our country, although the behavior of corporal punishment of students by teachers is prohibited in many laws, but in real life, the incidents of corporal punishment by teachers are not prohibited, and the incidents of teachers' corporal punishment continue to occur with social factors and cultural factors. Many factors, such as economic factors, legal factors, teachers' mental health factors, teachers' personal qualities and so on, are closely related to each other, and the provisions on corporal punishment of teachers in our country's educational legislation are mostly in principle. There is no clear definition of the connotation and extension of corporal punishment of teachers, which makes the legal provisions related to corporal punishment of teachers difficult to operate, which is also the main factor causing corporal punishment of teachers. The academic research on corporal punishment of teachers is mostly from the angle of psychology, sociology, economics and so on, and few scholars study it from the angle of law, which is not conducive to maintaining social stability and hindering the process of administering schools according to law. To destroy the image of teachers, we should pay attention to the fact that the greatest harm to teachers' corporal punishment is to harm the physical and mental health of the students who have been punished. In recent years, incidents of corporal punishment by teachers in our country have occurred frequently, even with an increasing trend. This issue should be of great concern to legislators. At present, more and more people from all walks of life are calling for the prohibition of corporal punishment by teachers, but on how to recognize and distinguish between corporal punishment by teachers, The problems of punishment and discipline are still unclear. As a result, there are two negative phenomena. On the one hand, individual teachers will continue to implement corporal punishment by taking advantage of loopholes in the law; on the other hand, some teachers will let go of the students' wrong behavior. This article combines the domestic and foreign research present situation and the main achievement, uses the standard analysis method, the case analysis method, The main content of this paper is divided into five parts: the first part: the introduction part, the background, significance and the current situation of the research at home and abroad. And the research ideas, research methods and innovative points are expounded. This paper studies the current situation of corporal punishment of teachers from the perspective of law. The second part is to define the concept of corporal punishment of teachers and discuss the characteristics of corporal punishment of teachers. The behavior of corporal punishment of teachers is contrary to the spirit of many laws and regulations, such as constitution, criminal law, civil law, etc. The third part: through the questionnaire survey to teachers, parents, students, etc. Analysis of the current situation of corporal punishment of teachers. Part 4th: by explaining the subjective and objective elements of teachers' corporal punishment and its imputation principle, Part 5th: the research on the path and strategy of rule of law to prevent and cure corporal punishment of teachers, through perfecting the legal system of educational entity, the legal system of educational procedure, and the legal mechanism of educational supervision. The legal system of educational relief expounds the specific ways to prevent and cure teachers' corporal punishment.
