论我国食品安全公益诉讼制度

【摘要】:食品安全是事关国计民生的大事,体现了一个国家的人民生活水平,国家的发展状况以及法治状况。“法者,天下之准绳”,食品是人类最基本的物质需求。食品的健康和放心是我们每一个人都关注的事情,因为它与我们的生活息息相关,与我们社会的安定不可分离,也与我们国家的可持续发展血脉相融。最近这几年,我们几乎每隔一段时间都能看到有关食品又出现了新报道,均不是正面消息。每次的食品安全事故一般都是在造成了严重的后果之后才会被报道出来,这也只是冰山一角。地方政府能掩则掩。厂家商家也很乐于用金钱赔偿了事,之后依然如故。行政责任人员可能懒散执法,或者以公权谋私利,睁一只眼闭一只眼。这些都是造成一直以来食品安全事故跌起但情况没有丝毫好转的原因。虽然我们现有法律已经为食品领域充实了大量的立法。但是真正得到很好实施并且能够用来规范制约食品厂家商家的却寥寥无几。在《食品安全法》颁行之后,我国的食品安全的不良状况已经有了较为显著地发展。之前经济的发展,社会公众在食品领域的需求越来越大,随之而来的是许多人为了经济利益大肆生产。有些可以按照规定生产经营。有些人却在暴利的诱惑之下违法生产经营有毒有害食品,食品行业领域的安全报道层出不穷,地沟油、过期肉制品、病死猪肉,诸如此类,使得人们开始思考,何时才能有一个安全的食品环境。而接连不断发生这些事件的大部分原因是由于我国法律制度不完善。从对违法生产经营的责任人的追惩,到对有监管职责的主体的追责,以及最终切切实实保护受害者权益,都没有做到位。对此,我们如果真正想为公众权益考虑,使得每一个公民都受到保护,应该尽早将食品安全权益上升为一项明确的公众权利来进行保护。自新《民诉法》中,我们从五十五条可以看到公益诉讼首次被写入法条之中。这为我们如何解决食品安全事故不断的困境提供了法律的依托。通过构建食品安全公益诉讼制度,相信这些问题都会变得容易解决。因此我们更应该从建立食品安全公益诉讼制度方面去着手,弥补法律的漏洞,适应时代的需求。我将通过从我国食品安全的现状,结合国外食品安全公益诉讼制度的经验启示来探究我国建立食品安全公益诉讼制度的必要性以及从哪些方面完善我国的食品安全公益诉讼制度。希望对我们国家构建食品安全公益诉讼制度有一定的价值。第一部分是从导论部分开始进入食品安全公益诉讼。在这部分中,明确了构建食品安全公益诉讼的目的和意义。阐述了食品安全公益诉讼的理论依据和现实依据。了解了研究的方法和研究的内容。第二部分是食品安全公益诉讼的概念入手。这一部分主要探讨了公益诉讼和食品安全公益诉讼。从行政手段无法保护食品安全公益、诉讼制度不足以保护食品安全公益以及食品安全公益诉讼制度更有利于保护食品安全公益制度来探讨建立食品安全公益诉讼制度的必要性。同时也阐述了食品安全公益诉讼制度所建立的理论基础。第三部分是食品安全公益诉讼制度的现状及问题分析,从我国食品安全公益诉讼的立法现状入手,到司法实践现状,进而探讨构建食品安全公益诉讼制度中将会遇到哪些问题。第四部分是国外食品安全公益诉讼的借鉴,通过对大陆法系食品安全公益诉讼和英美法系食品安全公益诉讼的相关了解,进而进行对比分析,从而找出可借鉴部分。第五部分是完善我国食品安全公益诉讼制度方面的建立。这一部分分别从食品安全公益诉讼制度的原告资格、食品安全公益诉讼制度的适用范围、食品安全公益诉讼制度的法律责任制度、食品安全公益诉讼制度的制度保障入手。系统探讨了如何完善我们国家食品安全公益诉讼制度。
[Abstract]:Food safety is a matter of great beneficial to the people's livelihood of a country, reflects the people's living standards, the country's development situation and the rule of law. "The law, the principle", food is the most basic human needs. The healthy and safe food is every one of us to pay attention to things, because it is closely related to we live, not with the stability of our society and our separation, the country's sustainable development compatible. Food safety accidents every time are generally will be reported in the after the serious consequences, this is just the tip of the iceberg. The local government can cover up the mask manufacturers. Businesses are willing to use the money for compensation after the accident, remains the same. The administrative responsibility personnel may be idle or enforcement. In order to gain power, close your eyes. These are caused by food safety accidents has been down but did not cause any better. Although we have a lot to enrich the existing legal legislation for food. The fifth part is the establishment of public interest litigation system for food safety in China.
