公务员录用“萝卜招聘”问题的法律规制

【摘要】:近年来,我国公务员录用考试爆出诸多怪象,例如“被贫血”、“被陪榜”、“被不及格”等等的“萝卜招聘”现象让人“瞠目结舌”。“萝卜招聘”从表面上看是公开面向社会招录,程序上也看似按部就班,,体现了公开、公平、公正的录用原则,但实际上是借公开招考之形式,大行违法乱纪的实质。其实,这个所谓的公开招考的职位早就被相关人员在私底下串通好,给了某些既定的对象,所有的录用程序和工作都围绕着如何让该既定对象“对号入座”。 “萝卜招聘”问题已经影响到公务员招考的公开、公正。尽管近几年有些地区开始提出了改进措施,试图减少公务员录用考试中的不公平现象,但效果甚微。本文针对“萝卜招聘”这一现实问题,从法律层面提出建议,避免这种问题的发生,从而促进我国公务员录用法律制度的公平公正,以便提高我国公务员队伍的整体质量。 本文主要包括以下内容:引言包括选题的依据和背景、研究意义和研究方法。第一部分是“萝卜招聘”问题的现实反思,包括“萝卜招聘”问题的根源、危害和其产生的制度原因。第二部分是解决“萝卜招聘”问题的法律制度建议包括解决“萝卜招聘”问题应遵循的基本理念;建立“萝卜招聘”问题的预防机制;完善公务员录用条件设定的制度规范;完善公务员考录的法律救济和完善考录制度的监督体系这四点内容。
[Abstract]:In recent years, many strange phenomena have emerged in the civil service recruitment examination in our country, such as "being anaemic", "being accompanied by the list", "being flunked" and so on "radish recruitment" is a phenomenon that makes people "jaw-dropping". "radish recruitment" is, on the face of it, open to the public. The procedure also seems to follow a step-by-step approach, embodying the principles of openness, fairness, and fairness. But in fact, it is the essence of violating the law and discipline by means of the form of public examination. In fact, The so-called public recruitment position has long been colluded in private and given to certain target groups, and all hiring procedures and work revolved around how to "get the right seat". The issue of "radish recruitment" has affected the openness and fairness of civil service recruitment, although in recent years some regions have begun to propose improvements in an attempt to reduce the inequities in the civil service recruitment examinations. But the effect is very little. In view of the practical problem of "radish recruitment", this paper puts forward some suggestions from the legal level to avoid the occurrence of this kind of problem, thus promoting the fairness and justice of the legal system of employment of civil servants in our country. In order to improve the overall quality of our civil service. This article mainly includes the following contents: the introduction includes the basis and the background, the research significance and the research method. The first part is the realistic reflection of the "radish recruitment" problem, including the root of the "radish recruitment" problem. The second part is the legal system suggestion to solve the problem of "radish recruitment", which includes the basic idea to solve the problem of "radish recruitment", the establishment of the prevention mechanism of "radish recruitment", Perfecting the system standard of the civil servant employment condition, perfecting the legal relief of the civil servant examination and perfecting the supervision system of the examination system.
