计件工资制中的加班制度法律问题探究

【摘要】:企业用人单位为提高生产效率,实现利润最大化,会尽量地使用计件工资制,劳动者为获得更多的报酬,在计件工资制下会主动加班。这种局面下,劳动者的加班问题受到忽视,其加班时间远超法定限制,用人单位一般不依法支付加班工资。造成这种现象的主要原因是用人单位对劳动定额和计件单价具有绝对的决定权,并且法律对劳动定额无专门规定,使其陷入了"尴尬"的局面。因此,必须细化法律对计件工资制下加班工资支付的规定,发挥工会对用人单位制定劳动定额和计件单价过程的监督,加强劳动行政部门的监管,从而实现对劳动者加班权益的保护。
[Abstract]:In order to improve production efficiency and maximize profits, employers will make use of the piece-rate system as far as possible, and workers will work overtime voluntarily under the piece-rate system in order to get more remuneration. The overwork problem of laborer is ignored, its overtime time exceeds the legal limit far, the unit of choose and employ persons does not pay overtime salary according to law generally, the main reason that causes this kind of phenomenon is that the unit of choose and employ persons has absolute decision power to labor quota and unit price of piece. And the law has no special regulations on the labor quota, which makes it "awkward". Therefore, it is necessary to refine the law's provisions on overtime pay under the piecework wage system. The labor union should give full play to the supervision of the labor quota and the unit price of the unit of choose and employ persons and strengthen the supervision of the labor administrative department so as to realize the protection of the workers' rights and interests of overtime.
