行政规范性文件备案审查纠错机制研究

【摘要】:行政规范性文件在政府行使公共管理职能中发挥着重要作用。加强对行政规范性文件的管理,不仅有利于从源头上保证行政机关依法行政,还有利于防止行政权力滥用,保护公民的合法权益不受侵害。本文以行政规范性文件备案审查纠错的基本问题为起点,阐述行政规范性文件备案审查的概念和主要功能。通过对纠错机制的主要构成要素,如纠错主体、纠错标准、纠错方式、纠错结果执行的分析,发现其存在着诸多问题和不足。主要问题包括:第一,立法规定不周延。一方面,缺少对纠错程序进行统一规范的全国性立法。另一方面,各地方性法规、地方政府规章对同一问题的规定不尽相同。第二,纠错能力不足。不仅在机构设置和人员配备上不完善,工作人员缺乏工作经验,而且对行政规范性文件的识别能力不足。第三,纠错方式不严密。一方面未明确规定可以适用的纠错方式。另一方面,也未明确具体措施的适用条件。第四,纠错结果难执行。第五,缺乏责任追究机制。针对现行纠错机制在运行中存在的问题,本文提出了几项完善建议。首先要提高纠错处理能力,主要从完善工作机构设置及人员配备以及提高识别行政规范性文件的能力上改进。其次,构建一种类型化的纠错方式。将各种纠错措施按照一定的标准确定各自所适用的范围,形成一种有机结构体系,使得各种纠错处理案件均能在体系中准确的找到最佳的纠错方式进行适用。再次,明确纠错标准。确立合法性与合理性双重标准。此外,完善纠错结果的执行。建立反馈机制,提出建立纠错结果执行后的反馈机制,不仅要明确反馈制度,还要对反馈制度的具体程序做细致规定。最后,完善责任追究。一方面,应严格行政规范性文件制定机关的责任追究,根据具体违法程度的不同,明确相应的责任。另一方面,对纠错机关未依法履行纠错职责的,应给予相应的处罚,明确其应承担的责任。
[Abstract]:Administrative normative documents play an important role in the government's public management function.Strengthening the management of administrative normative documents is not only conducive to ensuring the administration of administrative organs according to law from the source, but also conducive to preventing the abuse of administrative power and protecting the legitimate rights and interests of citizens from being infringed upon.Based on the basic problems of administrative normative document filing and correcting, this paper expounds the concept and main functions of administrative normative document record review.Through the analysis of the main components of the error correction mechanism, such as the subject of error correction, the error correction standard, the error correction method and the execution of error correction results, it is found that there are many problems and shortcomings in the error correction mechanism.The main problems include: first, the legislative provisions are not comprehensive.On the one hand, there is a lack of national legislation to standardize error correction procedures.On the other hand, local laws and regulations, local government regulations on the same issue are not the same.Second, the ability to correct errors is inadequate.Not only in the establishment and staffing of the organization is not perfect, the staff lack of work experience, but also the identification of administrative normative documents is insufficient.Third, error correction is not strict.On the one hand, there is no clear regulation of the applicable error correction methods.On the other hand, there is no clear conditions for the application of specific measures.Fourth, error correction results are difficult to implement.Fifth, the lack of accountability mechanism.In view of the problems existing in the operation of the current error correction mechanism, this paper puts forward several suggestions for perfection.First of all, we should improve the ability of error correction, mainly from perfecting the working organization setting and staffing, and improving the ability of identifying administrative normative documents.Secondly, a type of error correction method is constructed.According to certain standards, a kind of organic structure system can be formed, so that all kinds of error correction cases can find the best way to correct errors in the system.Again, clear error correction criteria.Establish double standards of legitimacy and rationality.In addition, improve the implementation of error correction results.To establish the feedback mechanism and to establish the feedback mechanism after the implementation of the error correction results, not only the feedback system should be clearly defined, but also the specific procedures of the feedback system should be carefully stipulated.Finally, improve accountability.On the one hand, we should strictly investigate the responsibility of the administrative normative document making organ, and make clear the corresponding responsibility according to the difference of the specific illegal degree.On the other hand, if the error-correction authorities fail to perform their error-correcting duties according to law, they should be punished and their responsibilities clearly defined.
