法律政策学视角下的民族政策法制化

【摘要】：中国的民族政策和民族法制在价值、内容、目标等方面密切联系、相互交融,但又有自身的特性。民族政策灵活易变、调整方式多样化,而民族法制则稳定、恒久、程序性强。调整民族关系、处理民族问题,应重视民族政策的"法制化",将基本性、长期性的政策纳入立法调整。民族政策的法制化大多遵循从政策调整到政策成熟再到形成立法的过程,并非所有政策都应转化为立法,而须对政策的内容加以甄别。应"为政策立法",即以法律手段保障政策的正当性和有效性,制定程序性规则,确保政策制定的规范化、民主化。
[Abstract]:China's national policy and national legal system are closely related to each other in value, content and goal, but have their own characteristics.The national policy is flexible and changeable, the adjustment way is diversified, and the national legal system is stable, permanent and procedural.In order to adjust ethnic relations and deal with ethnic problems, we should pay attention to the legalization of national policies and bring the basic and long-term policies into the legislative adjustment.The legalization of national policy mostly follows the process from policy adjustment to policy maturity to legislative formation. Not all policies should be transformed into legislation, but the contents of policies should be screened.It is necessary to "legislate for policy", that is, to guarantee the legitimacy and effectiveness of policy by legal means, to formulate procedural rules, and to ensure the standardization and democratization of policy making.
