论行政协商制度的建构

【摘要】:行政协商制度作为行政法理论与协商制度有机结合的产物,为行政主体与行政相对人搭建起理性交往与利益博弈的平台。作为一种行政程序,行政协商制度的设计初衷在于预防并减少行政纠纷发生的可能性,同时阻断后续可能产生的救济环节,节约行政与司法成本。行政协商制度的建构打破以往过分注重于事后救济研究的迷思,转而以“预防纠纷”为切入点进行系统性的建构。以“合意”为理念建构的行政协商制度,其以哈贝马斯“交往理性”为基础,重塑行政主体与行政相对人之间的关系纽带。较之现有制度设计,行政协商制度给予行政相对人更大的话语空间,同时起到监督行政主体与保障公众知情权的功能,具有独立价值。行政协商制度作为一种“善治”,其建构具有较高的可行性,其效用从微观上不仅可以提高行政相对人对行政决定的接受程度,而且可以使行政主体与行政相对人进入从“对抗”走向“合作”的良性循环,而从宏观上是改善当前社会行政纠纷高发、易发现状的迫切需要,更是社会管理模式从“管理”走向“治理”的一次有益尝试,同时也是对当前行政法理论与实践的发展与完善。 文章主体部分共分为四章,前三章为行政协商制度建构的理论部分,第四章为行政协商制度的具体建构部分。 第一章主要涉及行政协商制度的兴起背景。笔者分别从经济、政治、文化、社会四个维度,论证行政协商制度的兴起,表明该制度在当前具备建构的土壤,符合国家与社会的内在需求,具有建构的必要性。 第二章主要涉及行政协商制度的基本原理。笔者以行政法的理论变迁为切入点,提出行政协商制度建构的哲学基础与政治基础,继而在对其概念、特征进行论证的基础上,对该制度的学理定位与功能价值予以阐释,从不同面向完成对行政协商制度基本原理的阐述。 第三章主要涉及行政协商制度的可行性论证。笔者认为应当主要论证两个大问题:一方面是论证该制度的建构并没有突破当前依法行政基本原则的框架,行政协商的运行并未动摇公权力的基础,另一方面则是论证该制度是行政主体与行政相对人能够接受并执行的。为此,笔者通过法学、谈判学与伦理学三个面向,对行政协商制度的可行性予以论证。 第四章主要涉及行政协商制度的具体建构。笔者以前述的论证为基础,以“总论-分论”的形式开展论证。总论部分主要涉及诸如协商参与人的资格、协商标的、协商时间与地点、协商程序及其效力、协商文书等基本问题,分论部分则以行政立法活动与行政执法活动为代表,,分别进行行政协商制度在程序上的具体建构,主要包括协商参与人、可以协商的范围以及协商的具体步骤。与此同时,为保障与监督行政协商制度,通过对不同情形的分析,提出相应的保障与监督措施,确保行政协商制度的顺利运行。
[Abstract]:Administrative consultation system as a product of the combination of theory and negotiation of administrative law system, administrative body and the administrative relative person to build physical intercourse and the interests of the game platform. As a kind of administrative procedure, administrative consultation system is designed to prevent and reduce the possibility of administrative disputes occur at the same time, blocking subsequent possible relief link save, administrative and judicial costs. Construction of administrative consultation system breaks overly focused on relief study of myth, turn to "prevent disputes" as the starting point for the construction of the system. The "agreement" for the administrative consultation system of the construction of the idea, which is based on Habermas "communicative rationality", the ties between the remodeling the administrative body and the administrative relative person. Compared with the existing system design, administrative consultation system to give the administrative relative person more discourse space, and at the same time for supervision The administrative body and protect the public's right to know the function of independent value. Administrative consultation system is a kind of "good governance", the construction of a high feasibility, its utility from the micro can not only improve the administrative relative degree of acceptance of administrative decisions, but also can make the administrative body and the administrative relative person to enter the virtuous cycle from "against" to "cooperation", and from the macro is to improve the current social administrative dispute is high, easy to find the urgent need to shape, it is a useful attempt of social management mode from "management" to "governance", but also for the development and perfection of the administrative law theory and practice.
The main part of the article is divided into four chapters. The first three chapters are the theoretical part of the construction of the administrative consultation system, and the fourth chapter is the concrete construction part of the administrative consultation system.
The first chapter mainly discusses the background of the rise of administrative consultation system. The author from the economic, political, cultural, social four dimensions, the rise of administrative consultation system demonstration, show that the system has in the current construction of the soil, with the internal demand of state and society, it is necessary to construct.
The second chapter mainly involves the basic principle of administrative consultation system. Based on the theory of change of administrative law as the starting point, put forward the philosophical basis and political basis of construction of administrative consultation system, and then based on its concept, characteristics of argumentation, academic orientation and function value of the system is explained, from different aspects of completion the basic principle of administrative consultation system in this paper.
The third chapter mainly involves the feasibility of administrative consultation system. The author believes that we should mainly demonstrate two major problems: one is the construction of the demonstration system did not break through the current administrative law basic principle framework, basis of administrative consultation operation has not shaken the public power, on the other hand is to demonstrate that the system is the administrative subject and administrative the relative people can accept and implement. Therefore, according to the law, negotiation and ethics in three aspects, the feasibility of administrative consultation system to demonstrate.
The fourth chapter mainly involves the construction of administrative consultation system. Based on the above argument, the "general - Theory" out in the form of argument. The introduction part mainly involves the qualification of people such as negotiation and participation, CO brand, negotiation time and place, negotiation process and force, the basic problem of negotiation documents. Part is based on the administrative legislation and administrative law enforcement activities as the representative, respectively the specific construction of administrative consultation system in the program, including negotiation and participation, the specific steps can range consultation and negotiate. At the same time, for the protection and supervision of administrative consultation system, through the analysis of different conditions, put forward corresponding measures to guarantee and supervision, to ensure smooth running of administrative consultation system.
