贵阳市D村失地农民权益保障法律问题调查与研究

【摘要】：城市化进程的加快造成目前我国很多农民成为流离失所的一类群体,被迫涌入城市开始与原来截然不同的生活,在失去土地的同时,也失去了以土地为基础的各项财产权、用益物权等经济权利,也丧失了国家以农民为主体制定的各种社会保障政策和福利待遇,未来的就业发展也成了难题,征收的补偿款是否能够真正反映他们所遭受的各项损失,隐形收益和土地的预期发展利益是否得到补偿都是值得调查研究的内容,其出现问题的主要原因还是我国目前农地征收法律政策及执行情况方面的,为避免泛泛而谈,本文选取贵阳D村的征收实例,将因为贵阳市打造城市湿地旅游城市而被迫搬离D村的各项征收情况进行汇总展现后,并针对出现的各种法律问题给出自己的完善建议。第一部分即第一章,主要是将调研情况及数据进行整理分析,将被征收人的知情权、安置补偿权、就业权及其他相关权利进行展现,结合数据对这些权利进行分析,并提出此次征收安置补偿中存在的各种法律问题;第二部分主要是将调研数据反应出的问题归纳整理,将征收过程中出现的各类法律问题进行陈述,主要包括征收执行程序中、失地农民的知情权、参与权情况、补偿安置情况、失地农民的劳动就业及未来发展、社会保障权方面进行逐一概述;第三部分结合调研的数据信息和访谈资料着重对这些问题的内在原因进行剖析,仍然围绕第二部分提出的各项问题进行;第四部分是对出现的问题提出法律及实际操作方面的建议,仍然结合了以上章节中的五个方面,有针对性地结合贵阳市D村的实际情况,提出了五项具体的法律制度方面的建议和思考,是为了在未来的土地征收中,尤其是农村土地征收的过程中,避免再出现损害失地农民法律权益的事。
[Abstract]:As a result of the acceleration of urbanization, many farmers in our country have become a group of displaced people, forced to flood into cities to start a completely different life, losing their land while also losing their land-based property rights.Usufruct and other economic rights have also lost all kinds of social security policies and welfare benefits formulated by the state as the main body of the peasants, and the future employment development has become a difficult problem. Can the compensation collected really reflect the losses they have suffered?Whether the hidden income and the expected development benefit of land are compensated are the contents worthy of investigation and study. The main reason for the problems is the current law policy and implementation of farmland expropriation in our country. In order to avoid the general discussion,This article selects Guiyang D village expropriation example, will because Guiyang constructs the city wetland tourist city and forced to move away from the D village each collection situation to carry on the summary display, and gives own consummation suggestion in the light of the various legal problems.The first part, the first chapter, mainly analyzes the investigation situation and data, presents the right to know, the right to compensation, the right to employment and other relevant rights of the expropriated person, and analyzes these rights in combination with the data.And put forward a variety of legal problems in the collection and placement compensation. The second part is mainly to summarize and sort out the problems reflected in the survey data, and to state all kinds of legal problems in the process of expropriation, mainly including the procedure of expropriation and execution.The right to know, the right to participate, the situation of compensation and placement, the employment and future development of the landless peasants, and the right to social security are summarized one by one.The third part focuses on the analysis of the internal causes of these problems by combining the data information and interview data, and still focuses on the problems raised in the second part.The fourth part is to put forward the legal and practical suggestions on the problems, still combined with the above chapter of the five aspects, in the light of the actual situation of Guiyang D Village,This paper puts forward five specific legal system suggestions and thoughts in order to avoid further damage to the legal rights and interests of land-losing farmers in the future land expropriation, especially in the process of rural land expropriation.
