垃圾短信的法律问题研究

【摘要】:短信作为信息时代的产物,自产生之初,就从各个方面对社会的运行,人们的生活产生了巨大的影响。随着近年来科技的不断进步,手机已不再是奢侈品,而是人们生活所需的必备物品。短信业务内容的不断丰富,极大地方便了人与人之间的沟通交流,为人们的日常生活提供了极大的便利。在使用短信通讯这一基本功能之外,用户还可以通过短信获取新闻,天气,医疗等各类信息;也可以通过短信完成订房,订票,订餐,缴费等活动;还可以通过短信享受游戏,铃声,图片,电子书等各种娱乐服务。值得注意的是,短信在不断改善人们生活的同时,也产生了不可忽视的危害。这些危害主要是由垃圾短信造成的。如,有些垃圾短信含有不利于国家统一、抨击国家现有制度、破坏各民族间团结友好关系、鼓吹邪教不良教义等内容,危害了国家的安全;有些垃圾短信含有暴力、色情、迷信、造假等内容,歪曲了国家倡导的主流道德观与价值观,助长了不正之风,冲击了良好的社会秩序;有些垃圾短信会造成电信运营商经营成本以及维护成本的增加,同时也会给电信运营商的信誉带来不利影响;还有一些会对用户的财产权,隐私权,健康权等依法受保护的权利造成损害。面对垃圾短信问题,我国目前已有治理之策,涉及立法,司法,执法以及行业自律多个层面。但是,由于存在法律法规的不完善,监管的不力等问题,我国的治理措施并没有实现良好的效果。国外部分国家,如美国、英国、德国、日本等,面对垃圾短信问题均采取了相关的治理措施,并取得了良好的效果,使国家的安全,社会的稳定,企业及公民的合法权益得到了很好的保障,值得我国借鉴。在本篇论文的第一部分,笔者首先从垃圾短信的概念着手,以前人已有理论为基础,并结合现今我国的具体情况,提出垃圾短信的概念,以便于明确本文的治理对象及范围。在此基础之上,笔者充分分析垃圾短信的主要特点、主要表现及危害,希望借此来提高对垃圾短信相关问题的认识;第二部分分析了我国治理垃圾短信的现状以及存在的不足,如现有法律法规的不完善,专门法律的缺失,处罚力度太小,执法主体不明确,行业自律方式的不合理等;第三部分通过分析美国、英国、德国、日本等国家治理垃圾短信的经验:针对垃圾短信进行专门的立法、加强个人信息的保护、加大处罚力度、政府设立专门机构进行监管、落实手机实名制等,并从这些先进经验中得出对我国治理垃圾短信的启示;最后一部分,提出对我国治理及防范垃圾短信的完善建议,涉及立法、司法,执法以及行业自律四个层面。
[Abstract]:As a product of the information age, SMS has had a great impact on the operation of society and people's life from the beginning.With the development of science and technology in recent years, mobile phone is no longer a luxury, but a necessity for people to live.The continuous enrichment of short message business greatly facilitates the communication between people and provides great convenience for people's daily life.In addition to the basic function of SMS communication, users can also obtain news, weather, medical and other information through SMS; they can also use SMS to complete booking, booking, ordering meals, paying fees and other activities; they can also enjoy games through SMS.Ringtones, pictures, e-books and other entertainment services.It is worth noting that text messages in the continuous improvement of people's lives, but also the harm that can not be ignored.These hazards are mainly caused by spam messages.For example, some spam messages contain contents that are not conducive to national reunification, attack the existing system of the country, undermine the unity and friendly relations among all ethnic groups, preach evil cult doctrines, and so on, and endanger the security of the country; some spam messages contain violence and pornography.Superstition, counterfeiting and other contents distort the mainstream morality and values advocated by the state, encourage unhealthy tendencies and impact on good social order; some spam messages will cause the cost of operation and maintenance of telecom operators to increase.At the same time, it will have a negative impact on the reputation of telecom operators, and some will damage the user's property rights, privacy, right to health and other legally protected rights.Facing the problem of spam short message, our country has already had the management policy at present, involves the legislation, the judicature, the law enforcement as well as the profession self-discipline many aspects.However, due to the imperfection of laws and regulations, the weak supervision and other problems, China's governance measures have not achieved good results.Some foreign countries, such as the United States, the United Kingdom, Germany, Japan and so on, have taken relevant measures to deal with the problem of spam messages, and have achieved good results in making the country's security and social stability.The legitimate rights and interests of enterprises and citizens have been well protected and are worthy of our country's reference.In the first part of this thesis, the author begins with the concept of junk message, based on the previous theories, and combining with the concrete situation of our country, puts forward the concept of spam short message, in order to make clear the object and scope of this article.On this basis, the author fully analyzes the main characteristics, main performance and harm of spam SMS, hoping to improve the understanding of the problems related to spam SMS.For example, the existing laws and regulations are not perfect, the special laws are lacking, the punishment is too small, the subject of law enforcement is not clear, and the way of self-discipline of the industry is unreasonable. The third part analyzes the United States, the United Kingdom, Germany, and so on.The experience of Japan and other countries in dealing with spam messages: making special legislation on spam messages, strengthening the protection of personal information, increasing penalties, setting up special agencies to supervise and implement the real name system of mobile phones, etc.In the last part, the author puts forward some suggestions on how to improve the management and prevention of spam SMS in China, which involves four levels: legislation, judicature, law enforcement and industry self-discipline.
