【摘要】：我国农民专业合作社作为诱致性制度变迁的产物,承载了诸多经济和社会功能。自2007年《农民专业合作社法》实施以来,其作为破解“三农问题”的助推器成为耀眼的“政治明星”,得到了政府和相关公共资源的大力扶持。然而在实际的运行中,农民专业合作社的发展受到很多因素的影响,呈现出许多异化和不规范现象,这些问题不仅削弱了市场的运行效率,阻碍了农民专业合作社自身的健康发展,也是对我国“三农政策”实施的扭曲,损害了国家的公共财政安全和市场交易安全。在农民专业合作社的发展已经过一定量的扩张,迫切需要进行质的提升的背景下,农民专业合作社的监管问题逐步凸显,尤其是在农民专业合作社内部监管力量严重不足的情况下,对农民专业合作社的外部监管进行研究显得更为迫切和必要。全文除绪论和结语两部分外共分为四章。绪论主要是立足实证调研数据和材料,介绍了选题依据和研究的意义,概括了国内外的研究现状,并进行简要的述评。各章的研究脉络如下：第一章,农民专业合作社外部监管的背景。简要界定了合作社、农民专业合作社、外部监管等相关概念,从我国目前农民专业合作社发展的现状出发,结合实证,探究农民专业合作社发展实践中存在的不规范问题,分析了存在问题的原因。并从我国现有立法和实践的角度,探讨了农民专业合作社现有外部监管制度的缺位和不足。第二章,农民专业合作社外部监管的必要性和理论基础。针对理论和实务界“自由主义”与“干预主义”的争议,结合政府干预理论、信息不对称理论和外部性理论等,阐明了农民专业合作社外部监管的必要性,构建了我国农民专业合作社外部监管的理论基础。第三章,域外典型农业合作社监管制度的比较与借鉴。主要介绍法国、日本、英国等国家对农民专业合作社监管的立法和监管实践,得出可供我国借鉴的启示。第四章,加强农民专业合作社外部监管的对策和建议。探讨了我国农民专业合作社外部监管的目标、政府干预的范围和界限,明确了外部监管的内容,并从立法、执法、配套制度和措施等若干方面提出了构建、完善我国农民专业合作社外部监管制度的具体法律建议。
[Abstract]:As the product of induced institutional changes, specialized cooperatives of farmers in China bear many economic and social functions. Since the implementation of the Farmers' specialized Cooperative Law in 2007, it has become a dazzling "political star" as a booster to solve the "three rural issues", and has been strongly supported by the government and related public resources. However, in the actual operation, the development of farmers' specialized cooperatives is affected by many factors, and presents many dissimilation and non-standard phenomena. These problems not only weaken the efficiency of market operation, It hinders the healthy development of farmers' specialized cooperatives, and it also distorts the implementation of the "three rural policies" in China, and damages the national public finance security and market transaction security. Under the background that the development of farmers' specialized cooperatives has already gone through a certain amount of expansion and it is urgent to carry out qualitative upgrading, the supervision problems of farmers' specialized cooperatives have gradually become more and more prominent. Especially in the situation of serious shortage of internal supervision power of farmers' specialized cooperatives, it is more urgent and necessary to study the external supervision of farmers' professional cooperatives. In addition to the introduction and conclusion, the full text is divided into four chapters. The introduction is mainly based on empirical research data and materials, introduces the basis and significance of the research, summarizes the current research situation at home and abroad, and makes a brief review. The research context of each chapter is as follows: the first chapter, the background of external supervision of farmers' professional cooperatives. This paper briefly defines the related concepts such as cooperatives, farmers' specialized cooperatives, external supervision and so on. From the point of view of the present situation of the development of farmers' professional cooperatives in China, combined with the empirical evidence, this paper probes into the nonstandard problems existing in the practice of the development of farmers' professional cooperatives. The causes of the problems are analyzed. From the angle of legislation and practice in our country, this paper probes into the absence and deficiency of the existing external supervision system of farmers' specialized cooperatives. The second chapter, the necessity and theoretical basis of external supervision of farmers' professional cooperatives. In view of the controversy between "liberalism" and "interventionism" in theory and practice, combining with the theory of government intervention, the theory of information asymmetry and the theory of externality, this paper expounds the necessity of external supervision of farmers' specialized cooperatives. The theoretical basis of external supervision of farmers' specialized cooperatives in China is constructed. The third chapter, the comparison and reference of the typical agricultural cooperative supervision system. This paper mainly introduces the legislation and practice of supervision of farmers' professional cooperatives in France, Japan, Britain and other countries, and draws some enlightenment for our country. The fourth chapter, strengthens the farmer specialized cooperative external supervision countermeasure and the suggestion. This paper probes into the objective of external supervision, the scope and the limit of government intervention, clarifies the contents of external supervision, and puts forward the construction from several aspects, such as legislation, law enforcement, supporting system and measures, etc. The concrete legal suggestion that consummates our country farmer specialized cooperative exterior supervisory system.
