论我国房屋中介服务立法之完善

【摘要】:房地产行业如火如荼发展的同时,房屋中介服务行业也悄然兴起,并迅猛发展,并逐渐成为房地产业所不可或缺的组成部分。现实中,房屋中介服务行业为消费者买房、卖房、租房等带来了极大的便利,为其节省了不少的时间和精力,同时也推动、刺激这房地产行业的进一步发展。不过,房屋中介服务行业存在的问题也是我们所不能忽视的。由于,有利可图,我国大大小小的房屋中介服务机构数不胜数,众多的中介为了能在房屋中介服务行业中分一杯羹,往往无所不用其极,进而出现了诸多侵害消费者权益,扰乱市场秩序的违规违法行为,如“吃差价”、制造虚假信息、乱收费等等。这些违法现象产生的根源既是我国的房屋中介服务服务制度还不完善,存在着诸多的漏洞。本文即重点研究完善我国房屋中介服务制度的路径,并分六部分来阐释这一问题。 文章第一部分为绪论,主要探讨三方面的内容,即选题的现状,研究意义,研究范围以及研究方法,旨在为之后的研究奠定基础。 文章第二部分对房屋中介服务进行了概述:第一,介绍了房屋中介的概念。第二,阐释了我国房屋中介的发展沿革,分别探讨了古代、近代以及现代我国房屋中介服务的概况。第三,界定了我国房屋中介服务合同的法律属性。 文章第三部分主要我国房屋中介服务中存在的问题,并分析造就问题的原因。第一,我国房屋中介违法行为主要表现在隐瞒交易信息、吃差价、制造虚假信息、合同不规范乱收费等。第二,我国房屋中介违法行为的存在主要是由于我国房屋中介服务法律法规不健全、行业自律不够以及政府监管不力。 文章第四部分主要探讨域外房屋中介服务立法的发展状况,并重点分析美国、德国和我国台湾的房屋中介相关立法,并在比较分析的基础上,说明国外房屋中介服务立法对完善我国相关立法的启示。 文章第五部分重点探讨完善我国房屋中介服务立法的具体构想,从法律法规完善方面展开,并提出具体的完善方案。 文章第六部分是结论,旨在对之前的研究进行简要的总结分析。
[Abstract]:With the rapid development of the real estate industry, the housing intermediary service industry is also quietly rising, and rapid development, and gradually become an indispensable part of the real estate industry. In reality, housing intermediary service industry for consumers to buy, sell houses, rental housing and other brought great convenience, for it saved a lot of time and energy, but also promote, stimulate the further development of the real estate industry. However, the housing intermediary services industry is also the problem we can not ignore. As a result of the profit, there are numerous housing intermediary service organizations large and small in our country. In order to get a share of the housing intermediary service industry, many intermediaries often have nothing to do with it, and then a lot of consumers' rights and interests have been infringed. Illegal activities that disturb the market order, such as eating price difference, creating false information, charging fees and so on. The root of these illegal phenomena is that our housing intermediary service system is not perfect, there are many loopholes. This paper focuses on the path of perfecting the housing intermediary service system in China, and explains this problem in six parts. The first part of the article is the introduction, mainly discusses three aspects of the content, namely, the status quo of the topic, research significance, research scope and research methods, in order to lay a foundation for later research. The second part of the article summarizes the housing intermediary services: first, introduces the concept of housing intermediary. Secondly, it explains the history of the development of housing agency in China, and discusses the general situation of housing intermediary service in ancient, modern and modern China. Thirdly, it defines the legal attribute of the housing intermediary service contract in our country. In the third part, the main problems in China's housing intermediary service are analyzed, and the causes of the problems are analyzed. Firstly, the illegal behavior of housing intermediary in our country is mainly manifested in concealing transaction information, eating price difference, creating false information, and irregular charging of contract, etc. Second, the existence of the illegal behavior of the housing intermediary in our country is mainly due to the imperfect laws and regulations of the housing intermediary service, the insufficient self-discipline of the industry and the weak supervision of the government. The fourth part of the article mainly discusses the development of the legislation of housing intermediary service in foreign countries, and focuses on analyzing the relevant legislation of housing intermediary in the United States, Germany and Taiwan, and on the basis of comparative analysis. It explains the enlightenment of foreign housing intermediary service legislation on perfecting the relevant legislation of our country. The fifth part focuses on the concrete conception of perfecting the legislation of housing intermediary service in our country, and puts forward the concrete consummation plan from the aspect of perfecting the laws and regulations. The sixth part is the conclusion, which aims to summarize and analyze the previous research.
