我国专业学位研究生教育存在的问题及法律对策

【摘要】:我国专业学位自1991年开始实行,2009年后正式招收全日制专业学位研究生,二十多年来得到了快速发展。专业学位作为一种新型学位制度,调整了以往我国研究生教育只有学术型学位的学位结构和教育模式,有利于我国高等教育的长期发展和国际接轨。当然,专业学位教育在经历了过去二十多年快速发展的同时,其入学、培养等多个环节均不同程度地出现了若干问题。这些问题固然与我国高等教育尤其是专业学位教育领域的相关法律法规不完善、教育行政管理体制不适应时代要求等宏观因素密不可分,但是,为了我国专业学位教育制度在未来的健康有序发展,我们认为,对我国专业学位研究生教育中存在的问题进行深入分析,进而从法律制度上思考提出相关保障机制就显得非常必要和重要。 本文分为三个大部分: 首先从专业学位等相关概念入手,诠释我国专业学位的发展背景和历程。然后针对我国专业研究生培养的基本环节——入学、培养、考核及就业,从上述四个方面对其中存在的问题进行了分析,指出了我国专业学位教育发展中存在的相关法律法规不完善、社会参与力量薄弱等主要问题及这些问题产生的原因。最后在介绍美、英、日各国专业学位研究生教育制度发展过程及制度经验的基础上,从完善法律制度的角度,提出了我国专业学位发展的相应法律对策,主要包括:完善专业学位相关法律法规,明确专业学位法律地位;调整专业学位现有管理体制,完善专业学位自身体系;改革相关制度,保证专业学位教育质量;建立多元化考核制度,完善与职业资格认证制度的衔接。以期对我国专业学位研究生培养制度的改革和完善提供参考和帮助。
[Abstract]:Professional degree in China has been implemented since 1991. After 2009, it formally enrolled full-time professional degree graduate students, and has developed rapidly in the past twenty years. As a new type of degree system, professional degree adjusts the academic degree structure and educational model, which is beneficial to the long-term development of Chinese higher education and international integration. Of course, professional degree education has experienced rapid development in the past twenty years, at the same time, its entrance, training and many other links have appeared a number of problems in varying degrees. These problems are closely related to the imperfect laws and regulations in the field of higher education, especially in the field of professional degree education, and the inadaptability of the educational administration system to the requirements of the times, but, For the sake of the healthy and orderly development of our professional degree education system in the future, we think that the problems existing in the professional degree graduate education in our country are deeply analyzed. Furthermore, it is very necessary and important to put forward the relevant safeguard mechanism from the legal system. This paper is divided into three parts: First of all, from the professional degree and other related concepts, the interpretation of our professional degree development background and process. Then, in view of the basic links of professional graduate training in China-admission, training, examination and employment, the problems in these four aspects are analyzed. This paper points out the main problems existing in the development of professional degree education in China, such as imperfect laws and regulations, weak social participation, and the causes of these problems. Finally, on the basis of introducing the development process and system experience of the graduate education system of professional degree in the United States, Britain and Japan, and from the angle of perfecting the legal system, this paper puts forward the corresponding legal countermeasures for the development of professional degree in our country. It mainly includes: perfecting the relevant laws and regulations of professional degree, clarifying the legal status of professional degree, adjusting the existing management system of professional degree, perfecting the system of professional degree itself, reforming the relevant system, ensuring the quality of professional degree education; To establish a diversified assessment system and perfect the link with the professional qualification certification system. In order to provide reference and help for the reform and perfection of the training system of professional degree graduate students in our country.
