非全日制用工的劳动者权益保护研究

【摘要】:非全日制用工作为一种灵活的就业方式,如今广泛存在于第三产业。它因为用工成本低、工作时间弹性大等特点而备受青睐,不仅满足了劳动者自主择业和灵活就业的需求,也缓解了劳动力市场供求严重失衡的矛盾,成为促进就业的重要途径。我国相关立法过于强调非全日制用工的灵活性,而忽视其安定性,从而造成了非全日制劳动者的权益严重受损。如何在强调非全日制用工灵活就业的同时,保障非全日制用工劳动者的合法权益,是我国完善立法时必须慎重考虑的问题。 本文除了引言和结语外,共分为四个部分: 文章第一部分:“非全日制用工的一般理论”,首先从理论及立法层面对非全日制用工之概念进行界定,其次论述了非全日制用工的特殊性,最后阐述了非全日制用工形式对于灵活就业这一目标的积极意义,即在促进就业、满足不同劳动者的择业需求上具有较大的作用。 第二部分为“我国非全日制劳动者权益受侵害的现状及成因”,探讨了我国对非全日制用工在劳动合同、休息休假、报酬等方面的法律规定与我国非全日制劳动者权益受损害的现状,并从理论认识、实际情况以及立法技术上讨论了我国非全日制劳动者权益受到侵害的原因。其中,我国非全日制劳动者权益受到损害主要表现为:终止用工没有任何保护,劳动合同签订形式不能达到保障劳动者权益的目的等等。 第三部分“非全日制用工劳动者权益保护的域外立法经验及启示”则深入探讨了域外关于非全日制用工的相关学说以及关于保护非全日制劳动者的立法和措施,并结合我国立法现状探讨得出域外非全日制用工制度中劳动者权益保护的启示,即不仅要重视非全日制用工的发展,为保护劳动者权益作出努力,,还应当使平等保护成为立法基本原则。 在完成了理论铺垫、境外考察及我国立法检讨的基础上,第四部分将关注重点回归到我国非全日制用工制度的构建上。在我国非全日制用工法律路径的设计上,树立妥当的劳动关系认定标准,秉持体面劳动、平等待遇的原则,并针对我国存在的对非全日制劳动者保障不力的问题,在非全日制用工的终止保护、薪酬支付、工作时间等方面提出完善建议。
[Abstract]:As a flexible way of employment, part-time employment now widely exists in the tertiary industry. It is favored because of its low labor cost and large flexibility of working time. It not only meets the needs of workers to choose their own jobs and obtain flexible employment, but also alleviates the contradiction of serious imbalance between supply and demand in the labor market and becomes an important way to promote employment. The relative legislation of our country emphasizes too much the flexibility of part-time employment, but neglects its stability, which results in serious damage to the rights and interests of part-time workers. How to protect the legitimate rights and interests of part-time workers while emphasizing flexible employment of part-time employees is a problem that must be carefully considered when our country consummates legislation. In addition to the introduction and conclusion, this paper is divided into four parts: The first part of the article: "the general theory of part-time employment", firstly defines the concept of part-time employment from the theoretical and legislative levels, and then discusses the particularity of part-time employment. Finally, the positive significance of part-time employment for flexible employment is expounded, that is, it plays a great role in promoting employment and meeting the needs of different workers in choosing a job. The second part is "the present situation and causes of the infringement of the rights and interests of part-time workers in China", and discusses the labor contract, rest and leave of part-time workers in China. This paper discusses the reasons for the infringement of the rights and interests of part-time workers in China from the aspects of theoretical understanding, practical situation and legislative technology. Among them, the damage to the rights and interests of part-time workers in China is mainly manifested in: termination of employment without any protection, labor contract signing form can not achieve the purpose of protecting workers' rights and interests, and so on. The third part, "Extra-territorial legislative experience and enlightenment on the protection of the rights and interests of part-time workers", probes into the relevant theories of part-time employment and the legislation and measures to protect part-time workers. Combined with the current situation of legislation in our country, the enlightenment of the protection of workers' rights and interests in the foreign part-time employment system is obtained, that is, not only should we attach importance to the development of part-time employment, but also make efforts to protect the rights and interests of workers. Equal protection should also be made a fundamental principle of legislation. On the basis of theoretical foundation, overseas investigation and legislative review of our country, the fourth part will focus on returning the focus to the construction of part-time employment system in China. With regard to the design of the legal path of part-time employment in China, we should set up appropriate standards for the determination of labor relations, uphold the principle of decent work and equal treatment, and aim at the problem of inadequate protection for part-time workers in our country. Provide suggestions on termination protection, pay, working hours, etc.
