互联网时代下公民个人信息法律保护问题研究

【摘要】：21世纪以来,我国社会的信息化程度日益加深,互联网技术的不断进步,社会各界对公民个人信息价值的认识不断提高,公民个人信息在收集、加工、使用、储存以及传递等方面越来越便捷,同时公民个人信息安全问题在互联网广泛使用的今天已经成为一大社会热点难题。论文从网络时代下公民的个人信息安全保护面临的问题展开讨论,以期为我国公民的个人信息安全保护提供一些新的思路。论文首先对公民个人信息的定义进行了辨析,根据不同的分类标准对公民个人信息作了区分,公民个人信息保护的依据,之后分析了当前我国公民个人信息保护的现状,在当前保护下出现的问题。其次,选取了美国与德国两个对公民个人信息保护采取不同立法模式的国家,了解其先进的做法,为我国的公民个人信息保护找到有益的借鉴。直到今天为止,中国仍未制定出旨在增强公民个人信息安全保护的法律;另一方面,公民大多对其本人的相关信息缺乏足够的安全保护的意识。最后,结合我国的实际情况,提出了以统一立法模式的公民个人信息保护立法,并且做好与现行法律的协调过渡,增强网络服务行业的自律监管也是一种可行有效的途径,最后想方设法地提高公民对其本人信息安全的保护意识,真正地减少对公民个人信息的侵害,确保公民个人信息的安全。
[Abstract]:Since the 21st century, the degree of information in our society has deepened day by day, with the continuous progress of Internet technology, the value of citizens' personal information has been continuously improved, and the personal information of citizens is being collected, processed and used. Storage and transmission are becoming more and more convenient. At the same time, the security of personal information has become a hot social problem in the Internet. This paper discusses the problems faced by citizens' personal information security protection in the network age, in order to provide some new ideas for the personal information security protection of Chinese citizens. Firstly, the paper analyzes the definition of citizen's personal information, distinguishes the citizen's personal information according to different classification standards, and then analyzes the current situation of citizen's personal information protection in China. Problems that arise under current protection. Secondly, two countries, the United States and Germany, which adopt different legislative models for the protection of citizens' personal information, are selected to understand their advanced practices, and to find a useful reference for the protection of citizens' personal information in our country. To this day, China has not enacted any laws aimed at enhancing the security of its citizens' personal information. On the other hand, most of its citizens lack sufficient awareness of the security of their own relevant information. Finally, according to the actual situation of our country, it is a feasible and effective way to improve the self-regulation of network service industry by unifying the legislation model of citizen's personal information protection legislation, and making a good coordination and transition with the current law. Finally, we try our best to improve citizens' awareness of protecting their own information security, to reduce the infringement of citizens' personal information, and to ensure the security of citizens' personal information.
