论我国劳动法中的经济补偿金制度

【摘要】:经济补偿金是劳动合同立法上一项极具特色的制度,是劳动合同立法特有的和独立的解约补偿方式,充分体现了对劳动者倾斜保护的原则和目的。在现实生活中,作为引导用人单位合理、合法使用劳工的有效手段,经济补偿金制度对调整用人单位和劳动者之间的经济利益的发挥了重要作用,更是形成了我国劳动者维权救济制度中所规范的重要手段之一。本文在明确经济补偿金的性质的基础上,探究在立法与执法方面的实施改进意见与完善措施,为维护劳动关系双方主体的实质公平和合法权益而努力。
[Abstract]:Economic compensation is a special system in the legislation of labor contract. It is a special and independent way to cancel the contract. It fully embodies the principle and purpose of the protection of the laborer. In real life, as an effective means to guide employers to make rational and lawful use of labor, the system of economic compensation has played an important role in adjusting the economic interests between employers and workers. It also forms one of the most important means in the relief system of labor rights protection in our country. On the basis of clarifying the nature of economic compensation, this paper probes into the suggestions and measures to improve the implementation of legislation and law enforcement in order to safeguard the substantive fairness and legitimate rights and interests of both parties in labor relations.
