新疆国有建设用地出让监管问题研究

【摘要】:近年来,尤其是2010年中央召开新疆工作座谈会以来,新疆迎来跨越式发展的大好契机。土地资源作为新疆推进新型工业化、新型城镇化发展的重要载体,其开发利用面临新的机遇。国有建设用地出让作为土地资源管理的重要组成部分,其承担着规范土地市场、优化土地资源的合理配置及提高土地集约节约利用的作用。而当前,新疆土地市场还不够发育,通过市场对土地节约集约利用的调节机制还不够完善,对国有建设用地批后的监管较为薄弱,致使在国有土地使用权出让中出现违规现象。 本文选定行政监督理论作为研究分析框架,对新疆维吾尔自治区国有土地使用权出让监管现状进行分析。通过对自治区国有建设用地出让前、出让中、出让后监管典型案例进行调查,,对其中存在的违规及待完善的问题进行总结,针对存在的问题和问题产生的原因进行分析,运用行政监督理论构建自治区国有土地使用权出让监管机制,提出解决这些问题,完善自治区就国有土地使用权出让监管方面对策建议,促进新疆土地交易市场健康可持续发展。 本论文的创新之处,一是目前还没对自治区国有土地使用权出让监管方面进行调查研究。本文运用行政监督理论,结合自治区实际情况,就自治区国有土地使用权出让监管进行研究。二是针对研究成果,提出自治区国有土地使用权出让监管对策建议,对自治区国土资源执法监察总队日后强化此方面工作提供参考。
[Abstract]:In recent years, especially since the Central Committee held a forum on Xinjiang's work in 2010, Xinjiang has ushered in a great opportunity for leapfrogging development. As an important carrier of promoting new industrialization and new urbanization in Xinjiang, land resources are faced with new opportunities. As an important part of land resource management, the transfer of state-owned construction land is responsible for standardizing the land market, optimizing the rational allocation of land resources and improving the intensive and economical utilization of land. But at present, the land market in Xinjiang is not developed enough, the adjustment mechanism of land saving and intensive utilization through the market is not perfect enough, and the supervision of the state-owned construction land after approval is relatively weak, which leads to the phenomenon of violation in the transfer of the right to use the state-owned land. In this paper, the administrative supervision theory is chosen as the framework of research and analysis, and the present situation of supervision on the transfer of the right to use state-owned land in Xinjiang Uygur Autonomous region is analyzed. Through the investigation of the typical cases of supervision before, during and after the transfer of state-owned construction land in the autonomous region, the author summarizes the irregularities and the problems to be improved, and analyzes the existing problems and the causes of the problems. Using the theory of administrative supervision to construct the supervision mechanism of the transfer of the right to the use of state-owned land in the autonomous region, put forward the countermeasures and suggestions to solve these problems and improve the supervision of the transfer of the right to the use of the state-owned land. Promote healthy and sustainable development of Xinjiang land market. The innovation of this paper is that there is no investigation and research on the transfer of the right to use state-owned land. Based on the theory of administrative supervision and the actual situation of the autonomous region, this paper studies the supervision of the transfer of the right to use state-owned land in the autonomous region. The second is to put forward the countermeasures and suggestions to supervise the transfer of the right to the use of state-owned land in the autonomous region in view of the research results, and to provide a reference for strengthening the work in this area in the future by the Regional Land and Resources Enforcement Supervision team.
