中国主导湄公河次区域国际公共产品供给的路径分析——以中老缅泰四国湄公河联合巡逻执法为例

【摘要】:中老缅泰四国湄公河联合巡逻执法自2011年12月起,至今已完成四十七次。四国联合巡逻执法是四国合作提供区域性国际公共产品的一种方式和机制,其收益——打击跨国有组织犯罪、保障贸易通道顺畅、维护区域和平与安全——具有非排他性和非竞争性,不仅区域内单个国家、公民团体或个人的安全,而且整个区域的安全都从中获益。然而,四国联合巡逻执法行动本身存在缺陷,主要是:执法行动的法律基础薄弱、执法行动中的成本分担问题、合作机制如何进一步深化、怎样与有关国际组织或区域外国家合作。中国作为本地区负责任的大国,可以通过提供区域性国际公共产品的方式与周边国家增加互信、提升自身国际形象和区域影响力。因此,中国应与老缅泰三国尽快签署《湄公河流域执法安全合作协定》;发挥四国联合巡逻执法实践的正外部性和示范作用,推动四国乃至区域内所有国家的全面合作;至少在经济合作领域,加强与区域外大国在湄公河地区的战略对话,处理好与相关国际组织和区域外众多公共产品供给者的关系。
[Abstract]:Since December 2011, China, Myanmar and Thailand have completed 47 joint patrols of the Mekong River. Joint patrol and law enforcement among the four countries is a way and mechanism for the four countries to cooperate in providing regional international public goods. The proceeds of the joint patrol and law enforcement are to combat transnational organized crime and ensure smooth trade channels. Maintenance of regional peace and security-non-exclusive and non-competitive, not only for the security of individual States, civil groups or individuals in the region, but also for the security of the region as a whole. However, there are shortcomings in the joint patrol and enforcement of the four countries, which mainly include the weakness of the legal basis of law enforcement, the problem of cost sharing in law enforcement, and how to deepen the cooperation mechanism. How to cooperate with relevant international organizations or regional foreign countries. As a responsible power in the region, China can increase mutual trust with neighboring countries and enhance its international image and regional influence by providing regional international public goods. Therefore, China should sign the Mekong River Basin Law Enforcement and Security Cooperation Agreement with Laos, Myanmar and Thailand as soon as possible, give play to the positive externality and exemplary role of the four countries' joint patrol and law enforcement practice, and promote the comprehensive cooperation among the four countries and even all countries in the region. At least in the field of economic cooperation, we should strengthen the strategic dialogue with the major powers outside the region in the Mekong region, and deal with the relations with the relevant international organizations and the numerous public goods suppliers outside the region.
