【摘要】：饮用水水源关系人民的健康、国家的繁荣、民族的昌盛。在人口、环境压力不断加剧的中国,饮用水水源的保护成为重中之重。饮用水水源保护区法律制度旨在通过规划、划定不同等级的饮用水水源保护区、设立相应的保护措施,来保护饮用水水源不被污染和破坏,进而从根源上保护人们赖以生存的饮用水。饮用水水源保护区法律制度从确立到现在,不断得到发展和完善,但同时也存在不少问题,亟需得到改善和解决。本文首先对饮用水水源保护区法律制度进行概述,介绍饮用水水源保护区及其现状、饮用水水源保护区法律制度的产生与发展、饮用水水源保护法律制度的结构与特征。然后分析我国饮用水水源保护区法律制度存在的具体问题,分别以静态的角度,论述饮用水水源保护区法律制度在法律制度层面存在的问题;以动态的角度,论述饮用水水源保护区法律制度在法律治理层面存在的问题。并继续探寻问题背后的自然、科技、法治大环境等原因。由此,实现对饮用水水源保护区法律制度较为全面的问题认识。为拓宽饮用水水源保护区法律制度的建设思路,本文依次对美国、欧盟及其成员国英国、德国、日本和加拿大,进行制度的总结和分析。将这些国家在饮用水水源保护区法制建设中的有益经验,作为我国完善制度建设的参考。在文章的最后,对我国饮用水水源保护区法律制度的完善作出一些思考。完善饮用水水源保护区法律制度,是美丽中国建设对饮水源法制图景的要求,我们需要从发达国家的法制建设中学习借鉴经验,结合我国实际情况,找到问题的解决方案。
[Abstract]:Drinking water is vital to the health of the people, the prosperity of the country and the prosperity of the nation. In China, where the population and environmental pressures are increasing, the protection of drinking water sources has become a top priority. The legal system of drinking water source protection areas aims to protect drinking water sources from pollution and destruction by planning, designating different levels of drinking water source protection areas, and setting up corresponding protection measures. In turn, from the root of the protection of people's survival of drinking water. The legal system of drinking water source protection area has been continuously developed and perfected since it was established, but at the same time, there are still many problems, which need to be improved and solved. This paper first summarizes the legal system of the drinking water source protection area, introduces the drinking water source protection area and its present situation, the emergence and development of the drinking water source protection legal system, and the structure and characteristics of the drinking water source protection legal system. Then it analyzes the specific problems existing in the legal system of the drinking water source protection area in our country, discusses the problems in the legal system of the drinking water source protection area from the static angle, and from the dynamic angle, discusses the legal system of the drinking water source protection area in the aspect of the legal system. This paper discusses the problems existing in the legal system of drinking water source protection area. And continue to explore the problems behind the nature, science and technology, the rule of law and other reasons. Therefore, the realization of the drinking water source protection area legal system more comprehensive understanding. In order to broaden the thinking of constructing the legal system of drinking water source protection area, this paper summarizes and analyzes the legal system of the United States, the European Union and its member states, Britain, Germany, Japan and Canada. The beneficial experience of these countries in the legal construction of drinking water source protection area is taken as the reference of perfecting the system construction of our country. At the end of the article, some thoughts are made on the perfection of the legal system of drinking water source protection area in China. Perfecting the legal system of drinking water source protection area is the requirement of beautiful Chinese construction to the legal prospect of drinking water source. We need to learn from the legal construction of developed countries to learn from the experience and to find a solution to the problem according to the actual situation of our country.
