政府经营土地的法律分析

【摘要】:政府应当只是作为一个公益“守夜人”的角色存在于现代社会中,而不应该成为经营土地的主体,而在我国由于历史原因,政府经营土地又是一个客观存在且不容回避的事实,也曾经在我国土地市场化和农村城市化过程中发挥过一些有益的作用。现今,随着我国改革开放的深入、政府职能的转变,政府经营土地的弊端日益突出,引起了社会的广泛关注,因此重新构建政府在土地经营中的角色定位已迫在眉睫。 本文首先采取文献检索法浏览了近几年相关方向的学术论文与期刊,为本文前期框架理论的形成打下了较为坚实的基础;其次分析了中国政府在经营土地政策中存在的缺陷与不足;最后通过对比分析法对解决我国土地政策中的问题提出了完善构想。 本文共分为三部分: 第一部分对政府经营土地政策进行概述。首先介绍政府经营土地的涵义,然后探讨我国政府经营土地形成的法律基础,最后梳理我国政府经营土地制度的发展与演变。 第二部分首先重新定义我国政府经营土地的法律关系,明确在经营土地的土地征收、土地出让和征地补偿这三个环节中政府都应当承担法律责任与法律义务;然后提出我国政府经营土地制度中存在三个方面的问题:第一,公共利益问题,如何防止地方政府滥用公共利益,以“公共利益”之名,行“滥用公权”之实;第二,正当程序问题;第三,征地补偿问题。 第三部分主要讲政府经营土地的完善构想。首先介绍了国外政府在土地市场管理方面的经验,在此基础上对政府经营土地的行为进行合理规制。 本文创新之处在于从法律关系这一角度对政府经营土地进行分析,明确政府经营土地过程中的主体、客体以及内容,通过确立相关主体间的权利和义务,借鉴国外政府经营土地的经验,分析我国现有政府经营土地模式的弊端,试图摸索出一套可以与我国本土的实际情况良好配合的土地改革之路。
[Abstract]:The government should only exist as a public welfare "night-watchman" in modern society, and should not become the main body of land management. However, because of historical reasons, it is an objective and unavoidable fact that the government manages land in our country. Also has played some beneficial role in our country land marketization and the rural urbanization process. Nowadays, with the deepening of China's reform and opening up and the transformation of government functions, the drawbacks of government land management have become increasingly prominent, which has aroused widespread concern of the society, so it is urgent to re-establish the role of the government in land management. Firstly, this paper uses the method of literature retrieval to browse the academic papers and periodicals in the related direction in recent years, which lays a solid foundation for the formation of the frame theory in the early stage of this paper. Secondly, it analyzes the defects and shortcomings of the Chinese government in the land management policy, and finally puts forward a perfect conception to solve the problems in the land policy by means of comparative analysis. This paper is divided into three parts: the first part is an overview of the government land policy. This paper first introduces the meaning of government land management, then probes into the legal basis of the formation of government management land, and finally combs the development and evolution of our government land management system. The second part firstly redefines the legal relationship between the government and the land management in our country. It is clear that the government should bear the legal responsibility and the legal obligation in the land expropriation, the land transfer and the land expropriation compensation. Then it points out that there are three problems in the land management system of our country: first, the public interest problem, how to prevent the local government from abusing the public interest, in the name of "public interest", "abusing public power"; second, Due process; third, compensation for land expropriation. The third part mainly talks about the government management land consummation idea. First, the paper introduces the experience of foreign governments in land market management, and on the basis of this, reasonable regulation of government land management behavior is carried out. The innovation of this paper lies in the analysis of the government land management from the angle of legal relationship, the determination of the subject, object and content in the process of government land management, and the establishment of the rights and obligations among the relevant subjects. Based on the experience of foreign governments in land management, this paper analyzes the drawbacks of the existing mode of government land management in China, and tries to find out a set of land reform paths which can be well coordinated with the actual situation of our country.
