新疆进口食品安全监管的法律问题研究

【摘要】:近年来,随着全国食品问题的曝光,食品安全日趋成为了人们的焦点,,同时随着全球经济一体化的进程,在国际贸易中进出口食品安全的问题也越来越突显。而作为新疆,为我国边境线最长、对外开放口岸最多的省区,在我国与国际进出口贸易来往中占据着不可磨灭的地位。在党和国家的关怀下,新疆的经济发展状况和人民的生活水平日益提高,食品贸易也成为了打开新疆对外发展经济的窗口,进口食品再给新疆人民带来福惠的同时,进口食品安全问题也日益凸显。由于近些年来,进口食品出现的等等问题,使得各国对外国进入的食品进行了严格的限制和标准,造成了一定程度的贸易壁垒,阻碍了我国进出口食品贸易的发展。做为世界上最大的发展中国家,进出口食品贸易对我国影响深远,而我国在进出口食品安全法律方面起步较晚,很多法律、法规制度、各项技术标准都不够完善,在一定程度上不能与其他国家同步,而在对进口食品的监管上存在很多漏洞。因此加强和完善我国政府对进口食品的管制,如何扩大新疆进口食品市场,规范新疆进口食品市场的监管,加强与内陆地区的经济合作都是亟需解决的问题。本文将从新疆进出口食品市场背景出发,研究新疆进口食品市场发展的现状和前景,从我国《食品安全法》的角度分析新疆进口食品市场监管存在的主要障碍和问题,提出可行性建议。本文分为五章节: 第一章“进口食品安全相关理论概述”。本章首先介绍了进口食品安全的相关概念,以及从国际社会及各国对进口食品安全定义的界定和食品的特点,以及食品安全的内涵和食品安全监管的定义。 第二章“新疆进口食品安全状况”。本章首先从新疆进口食品基本状况和经营进口食品的企业资质条件两个方面,展开介绍新疆进口食品市场的基本状况,然后针对进口食品不合格总体情况对进口食品不合格状况及其原因做了具体分析。 第三章“国家进口食品安全立法与执法体制状况”。本章首先对国家进口食品安全的立法与执法状况进行了分析,阐明了我国进口食品安全监管法律的现状。然后分析了新疆进口食品安全执法监管具体问题。 第四章“对新疆进口食品安全监管的对策研究”。本章通过上文对新疆进口食品市场安全状况及当前执法状况的分析,对新疆进口食品安全监管工作提出相应的可行性建议及对策,加强食品安全制度的建设。
[Abstract]:In recent years, with the exposition of food problems in China, food safety has become the focus of people. At the same time, with the process of global economic integration, the problem of food safety in international trade has become increasingly prominent. With the concern of the Party and the state, Xinjiang's economic development and people's living standards are improving day by day. Food trade has become a window for Xinjiang's foreign economic development. Imported food brings benefits to the people of Xinjiang. At the same time, the problem of imported food safety has become increasingly prominent. In recent years, problems such as imported food have caused countries to impose stringent restrictions and standards on food imported from foreign countries, resulting in a certain degree of trade barriers, hindering the development of China's import and export of food trade. Import and export food safety laws started late, many laws, regulations and systems, various technical standards are not perfect, to a certain extent can not be synchronized with other countries, but there are many loopholes in the supervision of imported food. Standardizing the supervision of Xinjiang's imported food market and strengthening the economic cooperation with inland areas are all problems that need to be solved urgently.This paper will start from the background of Xinjiang's imported and exported food market, study the present situation and Prospect of Xinjiang's imported food market development, and analyze the main problems of Xinjiang's imported food market supervision from the Perspective of China's Food Safety Law. Obstacles and problems, put forward feasible suggestions. This article is divided into five chapters:
Chapter 1 "Overview of the relevant theories of imported food safety". This chapter firstly introduces the related concepts of imported food safety, as well as the definition and characteristics of imported food safety from the international community and countries, as well as the connotation of food safety and the definition of food safety supervision.
Chapter 2 "The Situation of Imported Food Safety in Xinjiang". This chapter firstly introduces the basic situation of Xinjiang's imported food market from two aspects: the basic situation of Xinjiang's imported food and the qualifications of enterprises operating imported food. Then it makes a concrete analysis of the unqualified situation of imported food and the reasons for the unqualified situation. Analysis.
Chapter 3 "The State Import Food Safety Legislation and Law Enforcement System". Firstly, this chapter analyzes the legislation and law enforcement of national import food safety, clarifies the current situation of China's import food safety supervision law, and then analyzes the specific problems of Xinjiang's import food safety law enforcement and supervision.
Chapter IV "Research on the Countermeasures of Import Food Safety Supervision in Xinjiang". Through the above analysis of Xinjiang's import food market security situation and current law enforcement situation, this chapter puts forward corresponding feasible suggestions and Countermeasures for Xinjiang's import food safety supervision, and strengthens the construction of food safety system.
