劳动领域群体争议的法律规制

【摘要】：在我国,劳动领域群体争议具有存在的客观性、效果的破坏性、部分诉求的合理性等矛盾的元素,给社会治理带来了高难度从界定集体劳动争议、集体协商争议与群体争议的关系入手分析我国对劳动领域群体争议高管制的内在逻辑,有助于我们看清我国群体争议面临的各种乱相、国家行为和个人行为都应该在一个社会系统内进行整合,和谐应当体现为政治、经济、社会的综合平衡,多元救济模式才是我国未来解决争议的方向。只有理顺体制才可能对"法律评价上的高否定""社会现实中的高容忍"模式进行改革。
[Abstract]:In our country, group disputes in labor field have the contradictory elements of objectivity, destructive effect and rationality of some demands, which bring high difficulty to social governance from defining collective labor disputes. The analysis of the relationship between collective bargaining dispute and group dispute analyzes the inner logic of the high regulation of group dispute in labor field in our country, which helps us to see clearly all kinds of disorder that group dispute faces in our country. State behavior and individual behavior should be integrated in a social system. Harmony should be reflected in the comprehensive balance of politics, economy and society. The multiple relief mode is the direction of resolving disputes in the future in our country. Only by straightening out the system can we reform the pattern of "high negation in legal evaluation" and "high tolerance in social reality".
