行刑衔接视野下的一事不再罚原则反思

【摘要】：针对同一违法行为既施以行政处罚又处以刑罚处罚是否违反一事不再罚原则,目前理论研究与制度实践存在着一定冲突。通过追溯一事不再罚原则在罗马法上的本义及其在两大法系中的传承、我国的发展,立足于我国公民的权益保护以及公法责任的体系,行政执法与刑事司法衔接中应采用有限的一事不再罚原则。同时,应在同步协调原则的指引之下实施不再罚的要求。
[Abstract]:There is a conflict between the theoretical research and the system practice on whether the principle of whether the same illegal act should be punished by administrative punishment or punishment is no longer a violation of the principle. By tracing back the meaning of the principle of no more punishment in Roman law and its inheritance in the two legal systems, the development of our country is based on the system of the protection of the rights and interests of our citizens and the responsibility of public law. The principle of no-punishment should be adopted in the connection between administrative law enforcement and criminal justice. At the same time, the principle of synchronization should be guided by the implementation of the requirement of no penalty.
