完善我国行政监督机制研究

【摘要】：从古至今,对国家政府的行政权力进行监督制约一直是我们聚焦的热点话题。国家政府权力作为统治的核心,在国家政权体系中发挥着重要的作用,如何实现对政府权力的监督制约,将会影响国家的前途和命运。而我国目前所采用的政府权力监督体系是对传统行政监督体制的继承和发展,随着我国法律体系的不断完善和法治精神的全面形成,原有的监督体系已经不再适应当前的社会形势,而且隐藏在原有体制下的弊端也逐渐的显现出来,进而影响了社会主义市场经济的进一步发展。所以,要实现行政权力监督的有效性,必须根据我国目前发展的现状,结合我国的现实条件,同时借鉴发达国家在行政权力监督方面所积累的经验,积极推动我国行政权力监督体系的建设。最终将我国建设成为高效、廉洁的政府,实现国家的民主富强。本文主要研究现阶段我国行政监督机制并就如何完善提出建议,全文围绕行政监督的基本理论知识、国内外行政权力监督体系的异同点、我国在行政权力监督方面的缺陷、我国如何进行行政权力监督的建设四个方面展开。通过阐述行政监督基本理论,即行政监督机制的含义、基本功能以及依法行政与行政监督机制三方面。结合国外的行政监督机制与我国的比较分析,汲取外国先进的管理理念,得出启示,并针对目前我国行政权力监督的现实情况,分析现阶段我国行政监督机制存在的问题,如:我国的监督法律体系不够完善、行政监督制度落后、行政监督方式单一、行政监督力度不强、行政监督过程和结果不透明等。继而对我国行政监督机制的完善提出了合理的建议,以期为我国行政监督机制更加高速运转有所裨益。
[Abstract]:Since ancient times, it has been a hot topic to supervise and restrict the administrative power of national government. As the core of government power, government power plays an important role in the system of state power. How to realize the supervision and restriction of government power will affect the future and destiny of the country. At present, the government power supervision system adopted in our country inherits and develops the traditional administrative supervision system. With the continuous improvement of our legal system and the comprehensive formation of the spirit of the rule of law, The original supervision system has no longer adapted to the current social situation, and the shortcomings hidden in the original system gradually appear, thus affecting the further development of the socialist market economy. Therefore, in order to realize the effectiveness of administrative power supervision, we must, according to the present development situation of our country, combine the realistic conditions of our country and learn from the experience accumulated in the administrative power supervision in developed countries. Actively promote the construction of administrative power supervision system in China. Finally, China will be built into an efficient, clean government, to achieve the country's democracy and prosperity. This paper mainly studies the present administrative supervision mechanism of our country and puts forward some suggestions on how to perfect it. The full text revolves around the basic theoretical knowledge of administrative supervision, the similarities and differences of administrative power supervision system at home and abroad, and the defects of administrative power supervision in our country. How to carry on the construction of administrative power supervision in our country is carried out in four aspects. This paper expounds the basic theory of administrative supervision, that is, the meaning of administrative supervision mechanism, its basic function, and three aspects: administration according to law and administrative supervision mechanism. Combined with the comparative analysis of foreign administrative supervision mechanism and our country, drawing on foreign advanced management concepts, draw inspiration, and in view of the current situation of our country's administrative power supervision, analyze the existing problems of our country's administrative supervision mechanism at the present stage. For example: our country's supervision legal system is not perfect, the administrative supervision system is backward, the administrative supervision way is single, the administrative supervision is not strong, the administrative supervision process and the result are not transparent and so on. Then it puts forward reasonable suggestions for the perfection of administrative supervision mechanism in our country, in order to benefit the higher speed operation of administrative supervision mechanism in our country.
