论我国湿地产权法律制度的构建与完善

【摘要】：湿地产权法律制度对湿地保护起重要作用。我国湿地产权法律制度目前尚未建立,其构建进路应当是:在湿地等自然资源统一登记和确权的试点改革的基础上,确立独立、统一的自然资源"湿地"类别,明确湿地使用权的用益物权属性。以湿地使用权为基本权利基础,区别国家所有和农村集体所有的湿地使用权,建立作为生态补偿权利基础的湿地地役权。
[Abstract]:The legal system of wetland property right plays an important role in wetland protection. At present, the legal system of wetland property right has not been established in our country, and the way to construct it is to establish an independent and unified category of natural resources "wetland" on the basis of the pilot reform of unified registration and confirmation of the right of natural resources such as wetlands. Make clear the property of usufruct of wetland use right. Based on the basic right of wetland use right, the wetland easement, which is the basis of ecological compensation right, is established by distinguishing the use right of wetland owned by the state from that owned by rural collectives.
