农村集体经营性建设用地入市障碍及对策

【摘要】:为保障农民的土地权益,推进城乡一体化建设。农村集体经营性建设用地应当与国有土地同价同权,实现农村土地交易无缝对接,建立城乡统一的建设用地交易市场。然而在实践中集体经营性建设用地的性质和流转缺乏法律制度保障;集体经营性建设用地分布不均;入市过程中地方政府和农村集体间存在利益冲突,存在侵吞农村集体组织土地利益问题。通过司法解释完善土地法律,赋予农村集体组织议价权;对可流转土地发放交易许可证,对属性界定含糊的土地性质重新划分等级定性;用行政许可方式对经营性建设用地所有权主体进行授权;引入企业化模式,创新入市流转收益分配法律制度。
[Abstract]:In order to protect farmers' land rights and interests, promote the integration of urban and rural construction. The construction land for collective management in rural areas should have the same price and the same right as the state-owned land, realize the seamless docking of rural land transactions, and establish a unified market for construction land transactions between urban and rural areas. However, in practice, the nature and circulation of collective management construction land is lack of legal system guarantee, the distribution of collective management construction land is uneven, and there are conflicts of interest between local governments and rural collectives in the process of entering the market. There exists the problem of embezzling the land interests of rural collective organizations. Improve the land law through judicial interpretation, endow the bargaining power of rural collective organization, issue the transaction permit to the transferable land, and reclassify the property of the land with vague definition. The administrative license is used to authorize the main body of the ownership of the operating construction land, to introduce the enterprise mode, and to innovate the legal system of income distribution in the circulation of the market.
