《中华民国矿业法》之当代价值研究

【摘要】：1930年,南京国民政府颁布《中华民国矿业法》,它在我国的矿业立法进程中有这重要的历史地位,一方面吸收借鉴了《大清矿务章程》与《中华民国矿业条例》中的立法精髓,同时借鉴国外矿业法律做出众多合乎国情的创新,正是这些法律制度的推陈出新,才成为我国近代以来第一部较为系统完善的矿业法律法典。因此,对于《中华民国矿业法》的研究具有一定的理论和现实意义,同时对于当代的矿业立法也有一些新的启发和立法上的借鉴作用。以《中华民国矿业法》具体的法律制度作为研究重点,首先,从南京国民政府时期时代背景的角度,分析《中华民国矿业法》的历史演进及立法体系。其次,深入研究整部法律的体例形成,从立法原则、指导思想和法律结构三方面来进行分析,使我们对此部法律有一个整体上的宏观把握。再次,对该部法律中的重点创新内容进行解析和阐释,主要是从矿业权制度、矿区分割制度和矿税制度、矿业用地制度以及矿业监督几个方面与先前的矿业立法进行对比分析。最后,对整部《中华民国矿业法》进行价值评析,主要阐释了其对当代矿业立法的启示。对当代的启示着重从构建现代矿业物权制度、兼顾小矿业发展、协调中央与地方的矿产资源利益分配以及注重生态与公平理念的矿业用地制度和建立法律、市场与公众参与三方联动的矿业监督制度等方面进行,从而得出当代矿业法律改进之处,以期能更好地发展当代的矿业立法,为实现我国矿业立法贡献出一份力量。近代矿业法制建设在南京国民政府时期达到了一个巅峰,这对当代我国矿产资源法的修订提供重要的借鉴作用。在矿业法律制度建设方面,南京国民政府的多种创新,对目前我国深入矿业改革、有效开展矿业立法活动提供了重要的参考与借鉴。
[Abstract]:In 1930, the Nanjing National Government promulgated the Mining Law of the Republic of China, which had an important historical position in the process of mining legislation in China. On the one hand, it absorbed the legislative essence of the Mineral Regulations of the Qing Dynasty and the Mining Regulations of the Republic of China, on the other hand, it made many innovations in accordance with the national conditions by drawing lessons from foreign mining laws. Therefore, the study of the Mining Law of the Republic of China has certain theoretical and practical significance. At the same time, it also has some new inspiration and legislative reference for the contemporary mining legislation. The legal system as the research emphasis, first of all, from the perspective of the historical background of the Nanjing National Government, this paper analyzes the historical evolution and legislative system of the Mining Law of the Republic of China. Secondly, it makes a thorough study of the formation of the whole legal system, and analyzes it from three aspects: legislative principles, guiding ideology and legal structure, so that we can have a complete legal system. Thirdly, the key innovations in this law are analyzed and explained, mainly from the aspects of mining rights system, mining division system and mining tax system, mining land system and mining supervision. Finally, the value of the whole Mineral Law of the Republic of China is evaluated. The enlightenment to the contemporary mining legislation is mainly expounded. The enlightenment to the contemporary society is focused on the construction of the modern mining property system, the consideration of the development of small mining industry, the coordination of the distribution of mineral resources between the central and local governments, the mining land system with ecological and fair ideas, and the legislation and the supervision of the mining industry with the participation of the market and the public. In order to better develop the contemporary mining legislation and contribute to the realization of China's mining legislation, the construction of modern mining legal system reached a peak in the period of Nanjing National Government, which provides an important reference for the revision of China's mineral resources law. With regard to the construction of mining legal system, the various innovations of Nanjing National Government have provided important reference and reference for China's mining reform and effective mining legislation.
