我国政府信息公开制度研究

【摘要】: 政府信息公开是现代民主理论和基本人权理论发展的结果。它确立了国家权力的公开运行模式,实现了公民对公共事务的知情权,更为民主行政、参政议政、监督行政提供了制度保障。政府信息公开不但具有重要的政治意义,本身也具有很重要的经济意义。据统计,政府掌握了大约80%以上的信息资源。政府拥有的信息资源是知识经济时代的重要资源,是推进经济社会进步的不可或缺的条件。为使这些资源能够真正发挥作用,提高社会资源的配置水平和政府的工作效能,就必须大力推进政府信息的公开与共享。随着我国社会主义法治国家建设的进一步加快和加入世界贸易组织后参与国际竞争的需要,尽快与社会主义市场经济体制相适应的统一完善的政府信息公开的法律保障制度已迫在眉睫。 至全力推行政府信息公开以来,各地区各部门按照中央的要求,结合实际,狠抓落实,全国政务公开工作取得了明显的成效,成为我国政治体制改革,民主与法治建设中的一大进步。各级政务部门利用信息技术,扩大信息公开,促进信息资源共享,推进政务协同,政务信息资源建设和服务取得成效,提高了行政效率,改善了公共服务,有效推动了政府职能转变。我国政府信息公开的制度建设和法制建设虽然有一定的发展,但仍处于探索阶段,政府信息公开还存在很多问题。如:公民信息公开意识薄弱、政府机关的服务意识淡薄、信息沟通渠道不畅通、监督和协调机制不健全、信息公开制度缺少立法支持、信息公开以权力为基础等。因此,我国政府信息公开的发展需要在理论上进行新的探索,并用新的理论来指导政府信息公开实践活动的进一步发展。 本文通过对政务信息公开理论的探讨,结合我国政府信息公开的现状,借鉴各国有益的经验,提出构建我国政府信息公开的基本对策。
[Abstract]:The publicity of government information is the result of the development of modern democratic theory and basic human rights theory. It establishes the public operation mode of the state power, realizes the citizen's right to know about the public affairs, and provides the system guarantee for the democratic administration, the participation in the administration and the supervision of the administration. The publicity of government information is not only of political significance, but also of economic significance. According to statistics, the government has about 80% of the information resources. The information resources owned by the government is an important resource in the era of knowledge economy and an indispensable condition for promoting economic and social progress. In order to make these resources play a real role and improve the level of allocation of social resources and the efficiency of the government, we must vigorously promote the openness and sharing of government information. With the further acceleration of the construction of China's socialist country under the rule of law and the need to participate in international competition after China's accession to the World Trade Organization, As soon as possible, the unified and perfect legal guarantee system of open government information is urgent to adapt to the socialist market economy system. Since the full implementation of the publicity of government information, various departments in various regions and regions, in accordance with the requirements of the central authorities and in combination with the actual situation, have made remarkable achievements in the work of opening up government affairs nationwide, which has become the reform of the political system of our country. A major step forward in the construction of democracy and the rule of law. Government departments at all levels have made use of information technology, expanded information disclosure, promoted information resource sharing, promoted government cooperation, achieved results in the construction and service of government information resources, improved administrative efficiency and improved public services. Effectively promote the transformation of government functions. Although the system construction and legal system construction of government information disclosure in our country has certain development, it is still in the exploratory stage, and there are still many problems in the government information disclosure. For example, the public awareness of citizen's information is weak, the service consciousness of the government organ is weak, the channel of information communication is not smooth, the supervision and coordination mechanism is not perfect, the information publicity system lacks the legislative support, the information publicity is based on the power, and so on. Therefore, the development of government information disclosure in China needs a new exploration in theory and a new theory to guide the further development of government information disclosure practice. Based on the discussion of the theory of government information disclosure and the current situation of government information disclosure in our country, this paper puts forward the basic countermeasures to construct the government information publicity in our country by referring to the beneficial experiences of other countries.
