论个人医疗信息的法律保护

【摘要】：个人信息保护立法在国内已经探讨了很长时间,在医疗信息化大力推进和互联网技术广泛应用的今天,个人医疗信息常常被非法收集、处理、传播和利用,不仅个人隐私遭到泄露,个人权利受到侵害,甚至财产利益也遭受损失。目前,我国关于个人医疗信息保护法律并不完善,都是零散的分布在一些相关法律中对其进行间接的保护,而缺乏一部专门的法律对其进行全面保护。本文从个人医疗信息概念与特征入手,并分析了个人医疗信息民法保护的权利基础,同时对个人医疗信息主体及其权利进行界定；笔者从我国个人医疗信息保护面临的主要问题和个人医疗信息法律保护现状入手,对完善我国个人医疗信息的法律保护进行了思考,本文重点是对我国个人医疗信息法律保护应遵循的基本原则进行阐述,最后,呼吁从立法保护、自律保护与技术保护的三个方面协调加强对个人医疗信息的保护。
[Abstract]:Personal information protection legislation has been discussed for a long time in China. Today, when medical information is vigorously promoted and Internet technology is widely used, personal medical information is often illegally collected, processed, disseminated and utilized. Not only personal privacy has been leaked, personal rights have been infringed, and even property interests have suffered losses. At present, the law of personal medical information protection in our country is not perfect, it is scattered in some related laws to carry on the indirect protection, but lacks a special law to carry on the comprehensive protection to it. Starting with the concept and characteristics of personal medical information, this paper analyzes the right basis of civil law protection of personal medical information, and defines the subject of personal medical information and its rights. Starting from the main problems of personal medical information protection in China and the current situation of legal protection of personal medical information, the author thinks about how to improve the legal protection of personal medical information in China. This paper focuses on the basic principles that should be followed in the legal protection of personal medical information in China. Finally, it calls for strengthening the protection of personal medical information from the three aspects of legislative protection, self-discipline protection and technical protection.
