论网络论坛事前审查制度

【摘要】：网络论坛是网民利用现代计算机网络技术搭建的网上交流场所，俗称BBS。它是一种计算机电子信息服务系统，向用户提供了一块公共信息发布白板，每个用户都可以在上面发布各种信息或提出个人看法。大多数的大型网站都建有自己的BBS，供用户和网民通过网络来结交更多的朋友，表达更多的想法，并逐渐形成一种网络化、信息化的虚拟社区。简而言之，网络论坛就是一个具有成熟社区所能提供服务内容的大型规模性局域网络信息交流平台，涉及到政治、军事、经济、民生、教育、娱乐、学术等各方面的综合信息服务功能需求。目前我国现行的《中华人民共和国计算机信息系统安全保护条例》、《互联网信息服务管理办法》、《互联网上网服务营业场所管理条例》、《中华人民共和国电信条例》、《商用密码管理条例》、《中国互联网络域名注册暂行管理办法》、《中共中央办公厅、国务院办公厅关于进一步加强互联网新闻宣传和信息内容安全管理工作的意见》和《中共中央办公厅、国务院办公厅关于进一步加强互联网管理工作的意见》等法律法规规定了国务院新闻办公室、信息化工作办公室、发展计划委员会、通信管理、信息产业、公安、教育、卫生、药品监督管理、文化、工商、新闻出版、广电、国家安全部、国家保密局、海关、密码管理机构等十七个政府部门在信息网络管理中的职权，其中对信息的审查占很重要的部分。本文尝试把我国现行的网络论坛事前审查制度分为两个主要部分，即是信息审查和身份审查，，对其特性、现状和法理进行探寻和研究。在此基础上，尝试研究审查制度的优缺点，探讨如何更好地保障公民网络言论自由权利，以及寻求现行审查工作的真实目标和所能起到的实际作用。
[Abstract]:Internet forum is an online exchange place built by Internet users using modern computer network technology, commonly known as BBS. It is a computer electronic information service system, which provides users with a public information release whiteboard, on which each user can publish various information or put forward personal views. Most large websites have their own BBS, for users and Internet users to make more friends, express more ideas, and gradually form a network, information virtual community. In short, an online forum is a large-scale local information exchange platform with content that mature communities can provide, involving politics, the military, the economy, people's livelihood, education, entertainment, Academic and other aspects of the comprehensive information services functional requirements. The current regulations of the people's Republic of China on the Security Protection of computer Information Systems, the regulations on the Administration of Internet Information Services, the regulations on the Administration of Business places for Internet Services, and the regulations of the people's Republic of China on Telecommunications, The regulations on the Administration of Commercial passwords, the interim measures for the Registration of Internet Domain names of China, the General Office of the CPC Central Committee, Opinions of the General Office of the State Council on further strengthening the work of Internet News propaganda and Security Administration of Information content, and the General Office of the CPC Central Committee, Opinions of the General Office of the State Council on further strengthening Internet Management, and other laws and regulations, such as the Information Office of the State Council, the Information work Office, the Development Planning Commission, the Communications Management, the Information Industry, Public Security, Education, Health, The functions and powers of 17 government departments in the management of information networks, such as drug supervision and administration, culture, industry and commerce, press and publication, radio and television, the Ministry of State Security, the State Security Bureau, the Customs, the password administration, etc. The examination of information is an important part of it. This paper attempts to divide the current network forum prior censorship system into two main parts, that is, information censorship and identity review, to explore and study its characteristics, current situation and jurisprudence. On this basis, this paper tries to study the merits and demerits of the censorship system, and discusses how to better protect the citizens' right to freedom of speech on the Internet, and to seek the true goal of the current censorship work and its practical role.
