“法治湖南”评估指标体系的建构

【摘要】：法治是一种全球化的意识形态，也是现代各国一直追求的目标。近几年，运用法治指数量化法治的评估活动不断出现。国外，比较典型的有世界银行的“全球治理指数”、世界正义工程的“法治指数”；国内，比较有代表性的是香港的法治指数、浙江余杭区的法治指数。尤其是余杭区2008年6月推出了中国内地首个法治指数，使法治评估由定性转为定量分析，实现了中国内地法治水平量化评估的零突破。湖南省作为中国中部崛起的中心省份，在法治发展中也不甘落后，率先出台了中国首部行政程序法典——《湖南省行政程序规定》。2011年通过了《法治湖南建设纲要》（以下简称《纲要》），，提出了湖南法治发展的总目标：到2020年，地方性法规规章更加完备，依法治国基本方略深入落实，公共权力运行规范，公民合法权益得到切实尊重和保障，全社会法治意识和法律素质普遍提高，经济社会秩序良好，人民安居乐业。运用法治指数对法治湖南进行评估，不仅有利于对当前法治发展水平做出有效测评，而且有利于及时发现法治发展过程中的各种问题并适时提出相应对策予以解决和完善。 全文共分五章：第1章为导论，阐述本文的选题背景和研究意义，并对文献进行综述。第2章法治评估指标体系的基本理论。在叙述法治评估与法治评估指标体系两者概念的辩证关系的基础上，指出当前法治评估面临的挑战，为展开全文奠定了扎实的理论基础。第3章为法治评估的国内外实践。旨在对法治评估的国内外实践进行简要介绍，为本文的构建提供实践的借鉴。第4章构建法治湖南评估指标体系的基本原则与框架。主要探讨湖南法治评估指标体系构建遵循的基本原则、几种模式的选择，及法治湖南评估指标体系的基本框架。第5章法治湖南评估指标体系的具体操作。本章主要从法治评估的主体、权重设计、基本数据的采集等研究方法与组织保障政策支持几个方面展开。
[Abstract]:Rule of law is a kind of ideology of globalization, also is the goal that modern country pursues all the time. In recent years, the use of the rule of law index quantification of the rule of law evaluation activities continue to appear. Abroad, the typical index of global governance of the World Bank, the index of the rule of law of the World Justice Project, the index of the rule of law in Hong Kong and the index of the rule of law in Yuhang District of Zhejiang Province are more representative in China. In particular, Yuhang District launched the first index of rule of law in mainland China in June 2008, which changed the evaluation of rule of law from qualitative to quantitative analysis, and achieved a zero breakthrough in quantitative evaluation of the level of rule of law in mainland China. Hunan Province, as the central province rising in central China, is not willing to lag behind in the development of the rule of law. The first administrative procedure code of China, "regulations on Administrative procedure of Hunan Province", was first promulgated. In 2011, the outline for the Construction of Hunan by Law was adopted, and the overall goal of the development of the rule of law in Hunan was put forward: by 2020, Local laws and regulations have become more complete, the basic strategy of governing the country by law has been thoroughly implemented, the operation of public power has been standardized, the legitimate rights and interests of citizens have been effectively respected and protected, the awareness of the rule of law and the legal quality of the whole society have been generally improved, and the economic and social order has been sound. The people live and work in peace and contentment. The evaluation of the rule of law in Hunan by using the index of rule of law is not only conducive to making an effective evaluation of the current level of development of the rule of law, but also conducive to the timely discovery of various problems in the process of the development of the rule of law and puts forward corresponding countermeasures to solve and perfect them. The thesis is divided into five chapters: the first chapter is the introduction, which explains the background and significance of this paper, and summarizes the literature. Chapter 2: the basic theory of index system of rule of law evaluation. On the basis of describing the dialectical relationship between the evaluation of the rule of law and the index system of the evaluation of the rule of law, this paper points out the challenges facing the evaluation of the rule of law at present, which lays a solid theoretical foundation for the full text. Chapter 3 is the domestic and foreign practice of rule of law evaluation. The purpose of this paper is to briefly introduce the domestic and international practice of rule of law evaluation, and to provide practical reference for the construction of this paper. The fourth chapter constructs the basic principle and the frame of the evaluation index system of the rule of law in Hunan. This paper mainly discusses the basic principles, the selection of several models and the basic framework of the evaluation index system of Hunan rule by law. Chapter 5: concrete operation of evaluation index system of rule of law in Hunan. This chapter mainly from the main body of the rule of law evaluation, weight design, the collection of basic data and other research methods and organizational security policy support several aspects.
