论法律保留原则在我国保障性住房准入机制中的适用

【摘要】：法律保留原则的本质与功能在于限制国家权力、保障公民权利。经过长期的发展,法律保留原则实现从侵害保留到功能结构主义的理论演进与完善。国际人权文件和部分国家宪法将住房权确认为公民的一项基本权利,社会福利性质的保障性住房是促进住房权实现的重要制度,部分国家也以法律保留的形式设定了保障性住房的保障目标、对象范围、申请条件等准入规范。本文在我国宪法和法律均缺乏有关规范的情况下,探讨我国保障性住房准入机制适用法律保留原则的必要性,促进我国保障性住房制度从单纯社会政策向法律规则的转变,规范、公平公正地保障公民住房权的实现。
[Abstract]:The essence and function of the principle of legal reservation lies in restricting the power of the state and protecting the rights of citizens. After long-term development, the principle of legal reservation evolves from infringing reservation to functional structuralism. International human rights instruments and some national constitutions recognize the right to housing as a fundamental right of citizens, and affordable housing in the nature of social welfare is an important system for promoting the realization of the right to housing, Some countries also set the security target, object range, application conditions and other access norms of indemnificatory housing in the form of legal reservation. In the absence of relevant norms in our constitution and law, this paper discusses the necessity of applying the principle of legal reservation to the admission mechanism of affordable housing in our country, and promotes the transformation of our country's affordable housing system from a simple social policy to a legal rule. Standardized, fair and impartial protection of the realization of citizens' right to housing.
