集体建设用地流转制度和流转现象的法经济学分析

【摘要】:改革开放以来,我国逐渐形成了城乡二元土地结构制度。相比于城市国有土地制度的不断完善,集体建设用地流转制度与流转现状之间出现了严重的脱节,集体建设用地入市现象的出现促使我们重新审视这一法律制度对经济和社会可持续发展的影响。本文在实地调查和查阅大量文献资料的基础上,对集体建设用地流转制度和流转现象进行了深入研究。文章主体共分四部分: 本文在第一部分明晰了集体建设用地流转的相关概念,结合我国立法状况,将研究对象细分为集体建设用地所有权流转制度和集体建设用地使用权入市现象,并分别结合法律法规和调研结果进行概述。 在文章第二部分,笔者着重对文中涉及到的相关法经济学分析方法进行理论概述,说明法经济学分析方法在集体建设用地流转制度和现象研究中的作用。 在文章第三部分,笔者通过运用福利改进理论、博弈均衡分析理论和有限理性理论,对集体建设用地所有权流转法律制度做出了评价,明晰了该制度对地方政府和农民行为的约束结果,并以此为基础说明了该制度在收入分配、市场前景、农民补偿和维护社会稳定方面存在的不足。 在文章第四部分,笔者承接上文对集体建设用地所有权流转法律制度不足之处的分析,结合制度变迁理论,明晰了集体建设用地所有权流转制度催生使用权入市现象出现的原因,并提出了这一现象在制度变迁过程中的内在问题。 本文试图通过对集体建设用地流转制度和流转现象的法经济学分析,实现以下两个目的:一是,为集体建设用地所有权流转制度改革提供更全面的理论参考。集体建设用地所有权流转制度的改革,应当综合考虑这一制度对农民权利的保护和对经济发展的促进,现行流转制度的不均衡之处恰恰是今后制度改革的着力点所在。二是,深化对集体建设用地使用权入市现象的理解。一切现象的产生都有其制度根源,找到这一制度根源的所在,一方面用以了解这一现象产生的原因,另一方面用以预测这一现象发展的过程中存在怎样的问题。
[Abstract]:Since the reform and opening up, our country has gradually formed the urban-rural dual land structure system. Compared with the continuous improvement of the urban state-owned land system, there is a serious disconnect between the circulation system of collective construction land and the current situation of circulation. The phenomenon of collective construction land entering the market makes us re-examine the influence of this legal system on the sustainable development of economy and society. On the basis of on-the-spot investigation and consultation of a large number of documents, this paper makes a deep study on the circulation system and phenomenon of collective construction land. The main body of this article is divided into four parts: in the first part, this paper clarifies the related concepts of collective construction land circulation, combining with the legislative situation of our country. The research object is divided into the ownership transfer system of collective construction land and the phenomenon of collective construction land use right entering the market, and it is summarized in combination with the laws and regulations and the results of investigation. In the second part of the article, the author focuses on a theoretical overview of the relevant legal and economic analysis methods involved in the paper, explaining the role of the legal and economic analysis methods in the study of the transfer system and phenomenon of collective construction land. In the third part of the article, the author evaluates the legal system of collective construction land ownership transfer by using welfare improvement theory, game equilibrium analysis theory and limited rationality theory. This paper clarifies the restraint result of this system to local government and farmer's behavior, and explains the deficiency of this system in income distribution, market prospect, farmer compensation and maintaining social stability on the basis of this system. In the fourth part of the article, the author carries on the analysis of the deficiency of the legal system of the transfer of ownership of collective construction land above, combining with the theory of institutional change. This paper clarifies the reason why the ownership transfer system of collective construction land gives birth to the phenomenon of entering the market of the right to use, and puts forward the internal problems of this phenomenon in the process of institutional change. Through the legal and economic analysis of the transfer system and phenomenon of collective construction land, this paper attempts to achieve the following two purposes: first, to provide a more comprehensive theoretical reference for the reform of ownership transfer system of collective construction land. The reform of the ownership transfer system of collective construction land should comprehensively consider the protection of farmers' rights and the promotion of economic development. The imbalance of the current circulation system is precisely the focal point of the system reform in the future. Second, deepen understanding of the phenomenon of the use of collective construction land in the market. The origin of all the phenomena has its institutional roots, to find out the root of the system, on the one hand, to understand the causes of this phenomenon, on the other hand, to predict the development of this phenomenon in the process of what kind of problems.
