域外道歉制度在医疗纠纷解决中的功能及立法启示

【摘要】：在美国,35个州和哥伦比亚特区通过了各自的道歉法,澳大利亚的全部6个州和2个领地也均已制定了道歉法。首先概述域外道歉法的制度起源和发展现状,着重关注其在医疗纠纷解决领域中的快速进展。其次,分析道歉法在医疗纠纷解决领域中快速发展的契合条件,即所突显的四大特有功能。最后,评析我国医疗纠纷解决领域中的强制赔礼道歉制度与域外道歉法的异同,澄清道歉法在我国医疗纠纷解决中的认识误区,并结合强制赔礼道歉作为我国法律中的特有现象这一立法传统,提出其在基本医疗卫生法上的立法构想。
[Abstract]:In the United States, 35 states and the District of Columbia have passed their own apology laws, and all six states and two territories in Australia have enacted apology laws. Firstly, the system origin and development status of foreign apology law are summarized, with emphasis on its rapid progress in the field of medical dispute resolution. Secondly, it analyzes the suitable conditions for the rapid development of apology law in the field of medical dispute resolution, that is, the four unique functions highlighted. Finally, this paper analyzes the similarities and differences between the compulsory apology system and the foreign apology law in the field of medical dispute resolution in our country, clarifies the misunderstanding of the apology law in the resolution of medical disputes in our country, and puts forward its legislative conception in the basic medical and health law in the light of the legislative tradition of compulsory apology as a unique phenomenon in the law of our country.
