绿色知识产权体系构建与优先发展研究

【摘要】：随着工业化进程的加速,环境问题日益突出,气候变暖,极端天气频发,水、土壤、大气、海洋的污染日益严重,生物多样性遭到严重破坏,资源的稀缺性逐步显现,给人类生存与发展带来了现实的威胁。作为最大的发展中国家,我国面临的发展与环境的冲突问题更为突出,调整产业结构、实施绿色发展是解决我国经济发展与环境保护矛盾的重要路径,从依赖环境、资源转向依靠科技和人才。作为与科技创新最密切的制度,知识产权已经成为国家竞争的核心内容,应在保护生态环境、实施绿色发展战略方面发挥关键性作用。但我国现行知识产权制度环保导向缺乏,绿色知识产权创新激励不足。本文以生态学、公共管理、知识产权等相关理论为基础,将生态伦理、环境保护的要求融入到知识产权的目的、价值、方法、原则以及具体措施之中,对现有知识产权制度进行“绿色化”改造,探索构建绿色知识产权体系,倡导优先发展绿色知识产权,并提出了相关配套激励措施。首先,论文从分析知识产权对生态环境的作用入手阐释了构建绿色知识产权体系的必要性。在分析国内外相关领域研究现状的基础上,结合相关理论和知识产权自身特点,分析了绿色知识产权的功能,面对我国现行知识产权制度在生态环境保护方面导向缺失的现状,以生态环境保护、实施绿色发展、应对国际竞争、建设知识产权强国为现实背景,论述了将生态伦理、保护环境的价值理念融入知识产权制度的必要性和迫切性。其次,论文以知识产权的权利客体或载体的“绿色化”或“生态化”为基础,进行了绿色知识产权的概念、内涵和体系的建构。在归类梳理国内外专家学者对绿色知识产权界定的基础上,通过界定绿色技术、绿色作品、绿色标识等权利客体,明确“绿色专利权”、“绿色著作权”、“绿色商标权”等绿色知识产权概念的内涵,着力从理念与目的、客体与内容、应用与保护等方面探索构建我国绿色知识产权体系,将知识产权静态制度和动态运用相结合,详细地阐述了绿色知识产权各组成部分的具体内容。第三,论文从实现绿色知识产权价值目标的角度,探讨了部分与绿色知识产权紧密相关配套制度。论文结合绿色知识产权的体系构建和作用发挥的需要,分析了生产者责任延伸制度,绿色产品标识制度,强制许可制度、合理使用制度和权利穷竭原则,行政和司法裁量“绿色化”等配套制度。第四,论文结合国际国内形势,以我国知识产权现有政策资源为基础,提出绿色知识产权优先发展策略。论文主张在区分绿色知识产权与普通知识产权的基础上,倾斜性地加大绿色知识产权的支持力度,采取优先审查、加大投资、减免相关费用、政府优先采购等多项优先发展措施,以满足知识产权现代转型、建设知识产权强国,实施绿色发展、改善生态环境的现实需要。
[Abstract]:With the acceleration of industrialization, environmental problems become increasingly prominent, climate warming, frequent extreme weather, water, soil, atmosphere and marine pollution are becoming more and more serious, biodiversity has been seriously damaged, and the scarcity of resources has gradually emerged. As the largest developing country, the conflict between development and environment is more prominent in China, and the industrial structure is adjusted. The implementation of green development is an important way to solve the contradiction between economic development and environmental protection in China. From relying on environment and resources to relying on science and technology and talent, it is the closest system to scientific and technological innovation. Intellectual property has become the core content of national competition and should play a key role in protecting the ecological environment and implementing the green development strategy. Based on the theories of ecology, public administration and intellectual property, this paper integrates the requirements of ecological ethics and environmental protection into the purpose, value and method of intellectual property. Among the principles and concrete measures, we reform the existing intellectual property system, explore the construction of green intellectual property system, advocate the priority development of green intellectual property, and put forward some related incentives. This paper analyzes the role of intellectual property to the ecological environment and explains the necessity of constructing green intellectual property system. On the basis of analyzing the current research situation of related fields at home and abroad, it combines the relevant theories and the characteristics of intellectual property itself. This paper analyzes the functions of green intellectual property rights, and in the face of the fact that the current intellectual property rights system of our country is lacking in the direction of ecological environment protection, adopts ecological environment protection, implements green development, and responds to international competition. This paper discusses the necessity and urgency of integrating the value concept of ecological ethics and environmental protection into the intellectual property system. Based on the "green" or "ecological" of the object or carrier of intellectual property rights, the paper carries out the concept of green intellectual property rights. On the basis of classifying and combing the definition of green intellectual property rights by experts and scholars at home and abroad, through defining green technology, green works, green marks and other right objects, This paper clarifies the connotation of the concept of "green patent right", "green copyright", "green trademark right" and so on, and explores and constructs the green intellectual property system of our country from the aspects of idea and purpose, object and content, application and protection, etc. Combining the static system of intellectual property with the dynamic application, the paper elaborates the specific contents of each component of green intellectual property in detail. Third, the paper discusses the realization of the value of green intellectual property from the point of view of realizing the value of green intellectual property. This paper analyzes the system of extending producer responsibility, the system of green product identification, the system of compulsory license and the system of green intellectual property. The system of rational use and exhaustion of rights, administrative and judicial discretion "green" and other supporting systems. Fourth, the paper combines the international and domestic situation, based on the existing policy resources of intellectual property rights in China. On the basis of distinguishing green intellectual property from ordinary intellectual property, the paper proposes to increase the support of green intellectual property, adopt priority review, increase investment, and reduce related expenses. In order to meet the needs of modern transformation of intellectual property, construction of intellectual property power, implementation of green development and improvement of ecological environment, the government gives priority to procurement and other development measures.
