【摘要】：植物品种是农业的基础,改善现有植物品种并培育新品种是现代农业快速发展的重要举措。知识经济的繁荣促进了知识产权制度的产生与发展。植物新品种权作为一种重要的创造性权利,作为农业知识产权的重要组成部分,正日益融入国际知识产权保护的体系。植物新品种保护是国家整体知识产权战略的重要一环。我国的植物新品种保护虽然起步较晚,但总体上呈现出蓬勃发展,不断成熟和完善的趋势。随着经济全球化和知识经济的日益深入,中国的植物新品种保护不可避免的融入国际植物新品种保护的主体,这既是机遇,也是挑战。本文旨在阐述植物新品种保护的基本理论和核心问题,勾勒当前国际植物新品种保护的轮廓,发现我国植物新品种保护存在的问题,为我国植物新品种保护的发展与完善提出自己的建议。文章的结构包括四个方面：基础理论、国际保护、国内保护和制度完善. 第一部分主要阐释植物新品种的基本理论和基本问题,帮助我们对植物新品种有一个清晰准确的把握。第二部分别从国际组织和条约、发达国家保护制度和生物技术的新挑战三个方面勾勒植物新品种国际保护的框架和现状。第三部分介绍我国植物新品种保护的历史、发展现状和基本制度,并提出加入91文本的可行性这一问题,衔接国际保护这一层面。第四部分分析我国现行保护制度的不足,剖析国际保护的理念与思路,提出自己对完善我国植物新品种保护制度的建议。
[Abstract]:Plant varieties are the basis of agriculture. Improving existing plant varieties and cultivating new varieties are important measures for the rapid development of modern agriculture. The prosperity of knowledge economy promotes the emergence and development of intellectual property system. As an important creative right and an important part of agricultural intellectual property rights, new plant variety rights are increasingly integrated into the system of international intellectual property protection. The protection of new plant varieties is an important part of the country's overall intellectual property strategy. Although the protection of new plant varieties in our country started late, it showed a trend of vigorous development, maturity and perfection. With the development of economic globalization and knowledge economy, the protection of new plant varieties in China is inevitably integrated into the main body of international protection of new plant varieties, which is both an opportunity and a challenge. The purpose of this paper is to expound the basic theory and core problems of the protection of new plant varieties, outline the current international protection of new plant varieties, and find out the problems existing in the protection of new varieties of plants in China. Some suggestions are put forward for the development and improvement of new plant varieties protection in China. The structure of the article includes four aspects: basic theory, international protection, domestic protection and institutional perfection. The first part mainly explains the basic theory and basic problems of new plant varieties, which helps us to have a clear and accurate grasp of new plant varieties. The second part outlines the framework and current situation of international protection of new plant varieties from three aspects: international organizations and treaties, protection systems of developed countries and new challenges of biotechnology. The third part introduces the history, current situation and basic system of new plant variety protection in China, and puts forward the feasibility of joining 91 text to link up with international protection. The fourth part analyzes the deficiency of the current protection system of our country, analyzes the idea and train of thought of international protection, and puts forward some suggestions for perfecting the protection system of new plant varieties in our country.
