商标权与商号权的冲突研究

【摘要】:商标和商号究其本质而言,均属于作为无形资产的知识产权的对象,具有区分功能。但这种区分功能也存在着些许差异:前者在于区别、表明商品的特定属性;后者在于通过商号特征或所拥有的含义,判断商品来自哪一个经营者。两者作为商业标识也具有内在的交叉性,为权利冲突提供了潜在的可能。冲突现象的日渐猖獗,“旁名牌”、“搭便车”等不正当竞争行为不断出现,对经济秩序的发展和维护造成了恶劣的不良影响。与此同时,我国在此领域的行政、立法、司法中存在一些缺陷,对妥善处理两种权利的冲突也带来了一些困难。于是,设计出何种制度才能杜绝二者之间的冲突,采取什么措施才能在冲突出现的情形下做到公正公平处理,这些问题一直是学者专家在近十几年不断讨论的问题。笔者试从商标权与商号权的联系出发,探讨他们的冲突的原因,有的放矢,对于怎样解决这一冲突进行预见性的系统分析,提出若干针对性的意见。论文构思如下,除了引言与结论,共分为四部分:第一部分介绍剖析商标与商标权、商号与商号权的概念、联系与区别。第二部分通过四个典型案例的始末、判决结果,对商标权与商号权的冲突形式及相互对抗效力进行总结分析,从而深刻挖掘出冲突产生的缘由。第三部分结合第二部分所描述的案例,联系最新修订的《商标法》,分析在现实生活中处理商标权与商号权冲突时所运用的基本原则。第四部分对于我国商标权与商号权冲突解决的相关思考。从我国现实的基本国情出发,从行政管理模式、法律制度、司法途径以及企业自身方面,对解决冲突提出一些针对性的建议。
[Abstract]:Trademark and trade name, in essence, belong to the object of intellectual property as intangible assets and have distinguishing function. However, there are some differences in the differentiation function: the former is the difference, which indicates the specific attributes of the commodity, and the latter is to judge which operator the goods come from through the characteristics of the business name or the meaning it has. They are also intersected as commercial logos, providing potential for conflict of rights. The increasingly rampant conflict phenomenon, "next brand", "free rider" and other unfair competition behavior continue to appear, the development and maintenance of economic order has caused adverse effects. At the same time, there are some defects in the administration, legislation and judicature in this field, which bring some difficulties to the proper handling of the conflict between the two rights. Therefore, what system can be designed to put an end to the conflict between the two, and what measures can be taken to deal with the conflict fairly and fairly? these problems have been discussed by scholars and experts in the past ten years. Starting from the connection between trademark right and trade name right, the author discusses the causes of their conflict, puts forward some suggestions on how to solve the conflict. In addition to the introduction and conclusion, the thesis is divided into four parts: the first part introduces the concepts, connections and differences between trademark and trademark right, trade name and trade name right. The second part summarizes and analyzes the conflict forms of trademark right and trade name right and the effectiveness of mutual confrontation through the beginning and end of four typical cases and the result of judgment, thus deeply excavating the cause of the conflict. The third part combined with the case described in the second part, with the newly revised Trademark Law, analyzes the basic principles used in dealing with the conflict between trademark right and trade name right in real life. The fourth part is about how to resolve the conflict between trademark right and trade name right. Based on the actual situation of our country, this paper puts forward some pertinent suggestions on resolving the conflict from the aspects of administration mode, legal system, judicial approach and enterprise itself.
